The First Resolutionon Organ TransplantAll praise be to Almighty Allah.Blessing and peace be on His Prophet Muhammadafter whom there is no prophet, and on all thosewho followed his way <strong>of</strong> guidance.The <strong>Islamic</strong> <strong>Fiqh</strong> <strong>Council</strong> during its 8 th session held at theheadquarters <strong>of</strong> the Muslim World League in MakkahMukarramah between 28 Rabi Al-Aakhir 1405H – 7 Jumad Al-Oula 1405H (19-28 January 1985) and on the request made bythe Muslim World League Office in the United States to the<strong>Council</strong>, looked into the issue <strong>of</strong> transplanting the organ <strong>of</strong> onehuman being into another, who is in need <strong>of</strong> that organ to makeup his idle organ in the wake <strong>of</strong> great strides made by modernmedical science with the use <strong>of</strong> latest technology.The <strong>Council</strong> reviewed the study prepared by SheikhAbdullah Ibn Abdurrahmah Al-Bassam in this regard, and itscontents that included the difference <strong>of</strong> contemporary <strong>Fiqh</strong>scholars on permissibility <strong>of</strong> transplanting the human organs andarguments <strong>of</strong> every group <strong>of</strong> scholars in favour <strong>of</strong> its views in thelight <strong>of</strong> the relevant Shari’ah evidences.After thorough discussion among its members, the <strong>Council</strong>was <strong>of</strong> the view that the arguments <strong>of</strong> those who permittransplant are stronger, therefore it adopted the followingresolution:First:The transplant <strong>of</strong> an organ from the body <strong>of</strong> a living humanbeing into the body <strong>of</strong> another human being who is in need <strong>of</strong>this organ in order to save his life or to restore the function <strong>of</strong>199
