Thescholars of Fiqh rules and regulations, while discussing the issueof whether any period can be without a Mujtahid or not, haveagreed that the door of Ijtehad is open to all those who fullfil itsconditions, which include the thorough knowledge of the Qur’anand the Sunnah, principles of the Islamic Fiqh and objects of theIslamic Shari’ah conditions and circumstances of time, rules ofpreference in the contradicting evidences, in addition to the factthat Mujtahid must be fair, trustworthy and God-fearing.Ijtehad has four categories:1. Mujtahid Mutlaq2. Mujtahid Madhab3. Mujtahid Tarjeeh4. Mujtahid in any particular issue or issues, and it is permissibleon the basis of the fact that Ijtehad may be in part, and it is apreferred view.Therefore, the Council unanimously decided the following:First:The need for Ijtehad in any era of time is an imperative need,because there are issues which have emerged in this age and werenot there in the past. Similarly new issues will emerge in thefuture. Prophet Muhammad (peace be upon him) approvedIjtehad for Mu’aaz Ibn Jabal (may Allah be pleased with him)when he said that he would do Ijtehad and would not hesitate, incase he did not have any textual provision in the Qur’an or theSunnah. Hence, Islam’s vitality and compatability for all timeswas assured as all the problems of different transactions, newsystems of investments and other social problems can be solvedthrough Ijtehad.214
