The third method (in which sperm and ovum are taken from amarried couple, and their insemination takes place externally ina test-tube, then the zygote is planted in the uterus <strong>of</strong> the wife,owner <strong>of</strong> the ovum.) is in principle acceptable in the Shari’ahview, however it is not secure at all due to doubts andcomplications which surround the whole operation, so thismethod should not be resorted to, unless there are cases <strong>of</strong>extreme necessity and after the above-mentioned generalconditions are met.4. In the two permissible cases, the <strong>Council</strong> decides that thelineage <strong>of</strong> the born child would belong to the couple, whoconstitute the source <strong>of</strong> sperm and ovum. The inheritance andother rights would be subject to the lineage, hence, when thelineage <strong>of</strong> the born child from man or woman is proved, therules <strong>of</strong> inheritance and other rights would apply accordinglybetween the child and those whose lineage is linked to him.5. Other methods <strong>of</strong> artificial insemination in both internal andexternal ways as explained earlier, are prohibited in the <strong>Islamic</strong>Shari’ah, and there is no scope to allow any <strong>of</strong> them, becauseboth sperm and ovum in these methods are not from husbandand wife, or because the woman who volunteers to conceivepregnancy is alien to the husband and the wife, who are thesource <strong>of</strong> sperm and ovum.This is due to the complications which are found in generalin the artificial insemination even in the two cases which arepermissible in the <strong>Islamic</strong> Shari’ah. This is also due to thepossibility <strong>of</strong> mixing <strong>of</strong> sperms or zygotes in the test-containers,especially when its practice is common and wide-spread.Therefore, the <strong>Islamic</strong> <strong>Fiqh</strong> <strong>Council</strong> advises those caring fortheir religion, not to resort to this practice except in case <strong>of</strong>210
