Chapter 1 – General InformationSection 1.6 Enforcement Responsibility1.6 ENFORCEMENT RESPONSIBILITYIt shall be the duty of the Board of County Commissioners, acting through the Director of PublicWorks and the County Engineer, to enforce the provisions of this manual.1.7 REVIEW AND APPROVALThe County will review all submittals for general compliance with these Roadway Standards. Anapproval by the County does not relieve the owner, owner’s engineer, or developer from finalresponsibility of insuring that the calculations, plans, specifications, construction, and as-builtdrawings are in compliance with this manual as stated in the owner’s engineer’s certificationprovided in accordance with Chapter 3.1.8 INTERPRETATIONIn the interpretation and application of the provisions of this manual, the following shall govern:A. In its interpretation and application, the provisions shall be regarded as the minimumrequirements for the protection of the public health, safety, comfort, morals,convenience, prosperity, and welfare of the residents of the County.B. Whenever a provision of this manual or any provision in any law, ordinance,resolution, rule, or regulation of any kind, contain any restrictions covering any of thesame subject matter, whichever standards are more restrictive or impose higherstandards or requirements shall govern.C. The standards in this manual shall not modify or alter any road construction planswhich have been filed with and accepted by the County prior to the effective date ofthis manual. This exception shall be subject to the conditions and limitations underwhich said plans were accepted by the Engineer.D. Any ambiguities in the interpretation of material contained in this manual shall beresolved through the appeals process.1.9 RELATIONSHIPS TO OTHER <strong>STANDARDS</strong>Since the County is the approval authority for land use changes, this manual, which stipulatescertain minimum conditions for land use changes, shall apply. If special districts impose morestringent standards, this difference is not considered a conflict, the more stringent standard shallapply. If the State or Federal Government imposes more stringent standards, criteria, orrequirements, these shall be incorporated into this document after the due process and publichearing(s) required to modify this manual.The intent of this manual is to establish the minimum acceptable standard. In all cases, thehighest possible engineering and construction standards should be used in the design of anyroad. Simply using a design standard presented in this manual will not guarantee theacceptance of a design by the Engineer and is therefore discouraged. This manual should beused for determining factors needed to plan, design, construct, maintain, and upgrade newroads and not as a substitute for knowledge, experience and sound judgment.Larimer County Rural Area Road Standards Page 1-2October 22, 2007
