Chapter 1 – General InformationSection 1.14 The Public Road SystemDA. If the DA conditions cannot be resolved at a staff level, the developer may appeal to theDirector of Public Works and if conditions cannot be resolved the applicant may request ahearing before the BCC to further discuss and resolve any outstanding issues.1.14 THE PUBLIC <strong>ROAD</strong> SYSTEMThe Colorado Revised Statutes define public roads as all roads over private lands that havebeen dedicated to the public use by deed and accepted by the Board of County Commissioners,so long as no vacation of the road has occurred.Public roads may or may not be maintained by the County. Larimer County maintains only thoseroads which the BCC, by written resolution, has agreed to maintain.The State statutes have vested Larimer County with powers, if they so choose, to maintain, layout, alter, add, delete, acquire property, and regulate traffic on the public roads under itsjurisdiction.1.15 NEW <strong>COUNTY</strong> <strong>ROAD</strong>SNew roads may be added to the County Road System by resolution passed by the Board ofCounty Commissioners. Sources of new roads are additions, realignments, relinquished StateHighways and Forest Service roads, subdivision and other development. Ordinarily, before anew road becomes a part of the County Road System, it passes through seven steps: planning,design, right-of-way acquisition or dedication, construction, inspection, warranty period, andpossible acceptance through resolution.The initial approval of subdivision road construction by the Engineer is for purposes of releasingthe applicant’s Development Agreement collateral and not for purposes of acceptance by theCounty for maintenance. All roads proposed in any development shall be constructed to therequired standard by the applicant with no liability or obligation for such construction ormaintenance by the County.1.15.1 Planning StandardsPrior to the design of a new road, the functional classification and the design speed mustbe determined. The design speeds are addressed under Chapter 4.If the developer's engineers have any questions in regard to the classification type of aparticular road or roads within a proposed development, they should contact theEngineer for clarification.Reserve strips or outlots controlling access to roads for other purposes shall not bepermitted except where required by the County or the control of the reserve strip oroutlot is placed in the County under conditions approved by the Board of CountyCommissioners.Situations may arise in which both the County and city or town or other agency becomeinvolved in the review of a given development. The following procedure shall then apply:1. Inter-Governmental Agreements. The conditions of the Inter-GovernmentalAgreements (IGAs) between the County and the incorporated area shall becomplied with.Larimer County Rural Area Road Standards Page 1-4October 22, 2007
