For this it is necessary to introduce the books with their completewording into the proceedings.Sylvia Stolz, lawyerRejectionAnnex 3: Ruling (of the 2nd Superior Penal Chamber of the MannheimDistrict Court):The motion by lawyer Stolz of 12 July 2007 to introduce into theproceedings the books listed in the annex is rejected, because the contentof the books mentioned is not part of the indictment, and it is thereforeimmaterial whether they meet the criteria of a statutory offense.CommentsPrior to this a motion by my lawyer to procure those seven books forthe defense had already been rejected with the same reason given, and amotion filed by the defendant shortly thereafter in order to determinewhether these seven books are scientific in nature or whether they atleast serve science suffered the same fate (see below).Since the prosecution neglected to prove during the trial that theseven books listed by them have any illegal content, the court could nothave sentenced the defendant for promoting these books, if strictly followingthe legal principle of in dubio pro reo (benefit of the doubt).And that is exactly what happened: The verdict does not even mentionthese seven books. Hence these points of the indictment had disappeared,because the prosecution had not paid attention. Which at firstlooked like the court’s total refusal toward the defendant was in factmore likely a broad hint to let the sleeping dogs of the prosecution lie.Further Motions of 12 February 2007Annex 4In the matter of Germar Rudolf I request that the Court may assumeas true that writings, as defined by the law, serving research and/or scienceare not illegal according to the last paragraph of article §130 Ger-231
