After more than an hour of telephone callsback and forth, orders came from Washington to arrest and deport me toGermany no matter what. Neither my recognized marriage to a U.S.citizen nor the well-documented fear of government persecution by wayof a long-term imprisonment in Germany for perfectly legal publishingactivities in the U.S. were considered a reason by the U.S. FederalCourt in Atlanta dealing with the case to exempt me from deportation.Although the Fifth Amendment to the U.S. Constitution guaranteesdue process for all persons present on U.S. territory – and not just U.S.citizens – the Federal Court rejected without reason my motion to staymy deportation until it had ruled in my pending case. 53 The U.S. SupremeCourt rejected my emergency complaint as well without any reasonsgiven. 54 My premature deportation therefore rendered my entireasylum proceedings moot, as the courts let the government create irreversiblefacts and cause irreparable damage, which could not even havebeen redressed by the most favorable court decision imaginable. Dueprocess was simply aborted in my case.On 14 November I was deported to Germany, where German officialsimmediately arrested me in order to serve the outstanding 14months prison sentence and to face a new penal trial initiated againstme for my publishing activities of the previous nine years while residingin England and the U.S. Although my publishing activities werecompletely legal in those countries, the German authorities opine thatthey have to apply the German Penal Code on legal activities in foreigncountries.525354I was told during my arrest that this alleged appointment should have served to take my fingerprintsand a passport-size portrait, although my fingerprints had already been taken back in2001 and I had regularly sent in updated portraits every year during my asylum proceedings,the latest just in spring 2005.
