CBRE | ST GEORGE SOUTH LONDON LTD7.0 7.0 <strong>Planning</strong> <strong>Planning</strong> Policy Policy Overview OverviewINTRODUCTION7.1 The Town and Country <strong>Planning</strong> Act 1990 (the “1990 Act”), the <strong>Planning</strong> andCompulsory Purchase Act 2004 (the “2004 Act”) and the Localism Act 2011establish the legislative basis for town planning in England and Wales. Togetherthese Acts establish a “plan led” system which requires local planning authorities todetermine planning applications in accordance with the statutory development plan(the development plan) unless material considerations indicate otherwise (section38(6) of the 2004 Act as amended by the Localism Act). In London the developmentplan comprises the borough plan and the London Plan.7.2 This section includes a summary of; the key principles contained within the National<strong>Planning</strong> Policy Framework (NPPF), site specific allocations, relevant designationsand associated development plan policy; and other relevant policy considerationsspecific applicable to the determination of these proposals. Commentary on theinterpretation of the policies and material considerations and how they apply tothese proposals is set out in the planning assessment chapter. A comprehensiveoverview of all relevant development plan and supplementary policy is set out inAppendix A.7.3 The statutory development plan for the Site comprises: The London Plan 2011; The London Borough of <strong>Southwark</strong>’s Local Development Framework (LDF) CoreStrategy 2011; and The London Borough of <strong>Southwark</strong>’s Unitary Development Plan 2007 (known as‘The <strong>Southwark</strong> Plan’) saved policies.7.4 Where there is a conflict between policies in the development plan, Section 38(5) ofthe 2004 Act provides that the most recently adopted policy takes precedence. As theLondon Plan was adopted more recently than either the LDF Core Strategy or<strong>Southwark</strong> Plan, where there is a difference in policy the London Plan takesprecedence.7.5 To support and explain the policies contained within the development plan, both theMayor and LB <strong>Southwark</strong> have published non-statutory planning guidance whichincludes Supplementary <strong>Planning</strong> Guidance (SPG) and Supplementary <strong>Planning</strong>Documents (SPDs). SPG and SPDs must be consistent with national and regionalplanning guidance, as well as the policy in the adopted development plan whichthey are intended to supplement. They must not introduce new policies or seek toallocate land for development that is not related to a statutory policy provision.7.6 Emerging policy is also addressed including: Early Minor Alterations to the London Plan (February 2012) The Mayor’s Draft Housing SPG (2011) The draft Bankside Borough and London Bridge SPD (2010)Page 17PLANNING POLICY OVERVIEW
