Guidel<strong>in</strong>es for a referral mechanism for traffickedwomen and children <strong>in</strong> FRYOSCE, together with the Work<strong>in</strong>g Group on Victims Assistance has developed“Guidel<strong>in</strong>es for a referral mechanism on Trafficked Persons <strong>in</strong> the FRY”. Theseguidel<strong>in</strong>es describe the system of identify<strong>in</strong>g the trafficked woman, and thesupport which should be given to her. Identification is go<strong>in</strong>g to be carried outby the representatives of government, <strong>in</strong>ternational organisations and NGOsdur<strong>in</strong>g the clear<strong>in</strong>g and referral process. The system <strong>in</strong>cludes all traffickedwomen, regardless of their <strong>in</strong>itial wish to stay or to leave the country, giv<strong>in</strong>gthem the possibility, once they are under protection, to decide if they want:(1) to return to the country of orig<strong>in</strong>; (2) seek asylum; or (3) be a witness <strong>in</strong>crim<strong>in</strong>al procedures aga<strong>in</strong>st traffickers.Once the clear<strong>in</strong>g and referral po<strong>in</strong>t has identified the needs of the victim, sheis transferred to the women’s shelter or a specialised orphanage, where shecan receive assistance <strong>in</strong> the form of safe accommodation, long term counsell<strong>in</strong>g,legal consultation and preparation for the next steps.The guidel<strong>in</strong>es also suggest that before the victim is sent back to her countryof orig<strong>in</strong>, all the partners should be <strong>in</strong>volved <strong>in</strong> prepar<strong>in</strong>g re<strong>in</strong>tegration measuresand safe conditions for return. The victims who take part <strong>in</strong> the IOM safereturn programme should be able to receive on return to their country of orig<strong>in</strong>(1) appropriate shelter<strong>in</strong>g, (2) medical, social and psychological counsell<strong>in</strong>g,(2) assistance <strong>in</strong> f<strong>in</strong>d<strong>in</strong>g job opportunities and hous<strong>in</strong>g, (3) protection bylaw enforcement when necessary and (4) f<strong>in</strong>ancial support.Follow-up monitor<strong>in</strong>g on the situation of the trafficked person should be establishedand agreed with the respective returnee.2.6. Legal reform and law enforcementIn June 2001, FRY signed and ratified the Palermo Convention and its two protocols97 and now is <strong>in</strong> the process of adjust<strong>in</strong>g national laws to <strong>in</strong>ternationalstandards. In October 2001, the Federal M<strong>in</strong>istry of Justice <strong>in</strong>itiated a Work<strong>in</strong>gGroup on Legal Reform, to work on the new anti-traffick<strong>in</strong>g provisions. Thenew law will <strong>in</strong>corporate anti-traffick<strong>in</strong>g provisions <strong>in</strong> the Crim<strong>in</strong>al Code, aswell as target<strong>in</strong>g laws that provide support for trafficked persons and protectionof their rights to social welfare and education and <strong>in</strong> the media.Representatives from the Federal M<strong>in</strong>istry of the Interior are also participat<strong>in</strong>g<strong>in</strong> the regional tra<strong>in</strong><strong>in</strong>g programmes and <strong>in</strong>itiatives organised with<strong>in</strong> theframework of the Stability Pact <strong>Traffick<strong>in</strong>g</strong> Task Force:• Regional tra<strong>in</strong><strong>in</strong>g on law reform for experts and parliamentarians fromBalkan countries organised <strong>in</strong> Belgrade <strong>in</strong> November 2001 by theCouncil of <strong>Europe</strong>;• Regional tra<strong>in</strong><strong>in</strong>g on <strong>Traffick<strong>in</strong>g</strong> and Smuggl<strong>in</strong>g of <strong>Human</strong> Be<strong>in</strong>gsorganised <strong>in</strong> Hungary <strong>in</strong> November 2001;• Co-operation with the SECI Centre <strong>in</strong> Bucharest, to which liaisonsofficers are to be nom<strong>in</strong>ated;• Co-operation with Interpol on the cases of traffick<strong>in</strong>g.8496.Charged with prostitution or other crimes and sentenced for deportation.IOM’s rules andregulations do not allow the Organisation to assist either irregular migrants who do notwant to return voluntarily or Governments/Authorities <strong>in</strong> the implementation of forceddeportation acts.97.UN Convention Aga<strong>in</strong>st Trans-national Organised Crime, Protocol on <strong>Traffick<strong>in</strong>g</strong> and Protocolon Smuggl<strong>in</strong>g.
