Legal reform and law enforcementThe FYR Macedonia Crim<strong>in</strong>al Code has no specific article that crim<strong>in</strong>alises traffick<strong>in</strong>g<strong>in</strong> human be<strong>in</strong>gs. The exist<strong>in</strong>g practice shows that traffick<strong>in</strong>g is not recognisedas a crime. Prosecution is usually achieved through the application oftwo articles of the Crim<strong>in</strong>al Code, mediat<strong>in</strong>g prostitution and illegal cross<strong>in</strong>gof a state border. Recently, the government has made efforts to <strong>in</strong>crease theefficiency of prosecut<strong>in</strong>g and convict<strong>in</strong>g traffickers but they are still limited bythe lack of an appropriate law, no testimonies from the witnesses and the attitudeof the police. The exist<strong>in</strong>g anti-slavery law (Art. 418) has been used onlyrecently and <strong>in</strong> exceptional cases.The National Council on <strong>Traffick<strong>in</strong>g</strong> and Illegal Migration, appo<strong>in</strong>ted by thegovernment <strong>in</strong> February 2001, has organised an Interdiscipl<strong>in</strong>ary Committeeled by the M<strong>in</strong>istry of Justice to work on harmonis<strong>in</strong>g Macedonian law with therequirements of the Palermo Protocols. Legal reform will <strong>in</strong>clude:• Introduction <strong>in</strong>to the Crim<strong>in</strong>al Code of the new crime of traffick<strong>in</strong>g <strong>in</strong>human be<strong>in</strong>gs, accord<strong>in</strong>g to the def<strong>in</strong>ition from the Palermo Protocol,and also add<strong>in</strong>g punishment to the exist<strong>in</strong>g provision for organisedforms of traffick<strong>in</strong>g;• Introduction of the crime of illegal border cross<strong>in</strong>g;• Change and amendment of the Crim<strong>in</strong>al Procedure Law to facilitatethe <strong>in</strong>vestigation of all forms of organised crime activities; <strong>in</strong>clusionof new <strong>in</strong>vestigative techniques (electronic and other forms of surveillance);• Change of the exist<strong>in</strong>g regulations on labour and health <strong>in</strong>spection toenhance the ability to identify trafficked women by <strong>in</strong>troduc<strong>in</strong>gchanges <strong>in</strong> the Labour Code and Health Legislation, and by issu<strong>in</strong>gwork permits;• Improvement of <strong>in</strong>ternational co-operation with other countries forthe purpose of extradit<strong>in</strong>g traffickers;• New asylum law – already <strong>in</strong> draft form.With<strong>in</strong> the M<strong>in</strong>istry of Justice, the Legal Policy Work<strong>in</strong>g Group has been harmonis<strong>in</strong>gthe exist<strong>in</strong>g anti-traffick<strong>in</strong>g legislation with <strong>in</strong>ternational law. Thenew article on traffick<strong>in</strong>g has been drafted (Art. 418a), submitted to the Parliamentand now awaits its approval.With<strong>in</strong> the police force, the Task Force to Combat <strong>Traffick<strong>in</strong>g</strong> was set up <strong>in</strong>2000, with representatives <strong>in</strong> all districts.In March 2001, the Public Prosecutor’s Office issued a letter to the governmentexpress<strong>in</strong>g concern with the low number of prosecutions for traffick<strong>in</strong>g– 80 cases <strong>in</strong> the period 1997 to 2000. Only 30 cases have been completed.One person received a sentence of five years <strong>in</strong> prison, but the rest only f<strong>in</strong>esand parole. Forty-seven cases are still pend<strong>in</strong>g, and four have been dismissed.The difficulty with the prosecution of traffickers is that there is no evidenceaga<strong>in</strong>st them that can be presented <strong>in</strong> the court. The witnesses – traffickedwomen – are not present. In conclusion, the public prosecutor po<strong>in</strong>ted out that113
