Legal reform and law enforcement5.1. SummaryIn all countries of the region, the exist<strong>in</strong>g legislation has been reviewed, andlegal reform has or is tak<strong>in</strong>g place with the aim of harmonis<strong>in</strong>g the exist<strong>in</strong>glaws with the Palermo Protocol and with EU standards, and <strong>in</strong>sert<strong>in</strong>g specificanti-traffick<strong>in</strong>g articles <strong>in</strong>to the Crim<strong>in</strong>al Codes. In some cases, there is alsowork to be done on provisions to protect trafficked persons and ensure thatthey receive reparations <strong>in</strong> the Crim<strong>in</strong>al Procedures Codes, Labour Codes andCivil Codes. However, <strong>in</strong> some countries the reform is not yet completed and<strong>in</strong> others the new anti-traffick<strong>in</strong>g legislation is not yet implemented.Unf<strong>in</strong>ished legal reform and lack of tra<strong>in</strong>ed judges and prosecutors are botharguments used by governments to expla<strong>in</strong> the lack of successful prosecutionsof traffickers. However, as the results of the analysis of the Crim<strong>in</strong>al Code ofAlbania show, 169 exist<strong>in</strong>g law (even without special anti-traffick<strong>in</strong>g provisions)if implemented and used <strong>in</strong> traffick<strong>in</strong>g cases, could be sufficient to prosecutetraffickers for crimes committed aga<strong>in</strong>st trafficked women. What is lack<strong>in</strong>g isthe understand<strong>in</strong>g of the issue of traffick<strong>in</strong>g by law enforcement agencies andthe judiciary, and the political will to take the issue seriously and to deal withit, <strong>in</strong>clud<strong>in</strong>g deal<strong>in</strong>g with the corruption of state employees.Another obstacle to effectively combat traffick<strong>in</strong>g is a lack of clear understand<strong>in</strong>gof the dist<strong>in</strong>ctions between traffick<strong>in</strong>g, illegal migration, smuggl<strong>in</strong>g ofmigrants and prostitution among representatives of the <strong>in</strong>stitutions that dealwith trafficked persons. There is also too little understand<strong>in</strong>g of traffick<strong>in</strong>gamongst the judiciary and law enforcement officers who demonstrate a reluctanceto treat it as anyth<strong>in</strong>g than prostitution or illegal migration.
