<strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Human</strong> Be<strong>in</strong>gs<strong>in</strong> <strong>Southeastern</strong> <strong>Europe</strong>tarily will<strong>in</strong>g to return home, and offers medical and social services, providedby IOM. Women and girls can stay <strong>in</strong> the shelter dur<strong>in</strong>g the time it takes toprepare the travel documentation. If necessary, they can stay <strong>in</strong> the countryfor up to 3 months for stabilization.AlbaniaThe local NGO NPF is work<strong>in</strong>g on the re<strong>in</strong>tegration of children com<strong>in</strong>g backfrom Greece. Accord<strong>in</strong>g to their assessments, 80 percent of their beneficiarieshave been trafficked. The programme of re<strong>in</strong>tegration for children traffickedto Greece <strong>in</strong>cludes:• Assessment of the situation <strong>in</strong> Greece, <strong>in</strong> co-operation with Greekorganisations;• Monitor<strong>in</strong>g of <strong>in</strong>formal repatriation (by NGOs);• Re<strong>in</strong>tegration of children <strong>in</strong>to schools (special classes, special education,support <strong>in</strong> adaptation, vocational tra<strong>in</strong><strong>in</strong>g);• Development of a legal model for the protection of trafficked children,and lobby<strong>in</strong>g for children’s rights.The local NGO Women’s Hearth <strong>in</strong> Vlora is manag<strong>in</strong>g a shelter for Albaniantrafficked women and girls returned from abroad and for foreign illegalmigrants, who have been stopped while <strong>in</strong> transit through Albania to Italy. Theshelter is supported by Save the Children and USAID. It also provides basicassistance for illegal migrants who have been deported from a third countryand await deportation from Albania. These women are screened by UNHCR atthe shelter, and those who are will<strong>in</strong>g to return home are referred on to IOM<strong>in</strong> Tirana. The shelter will be a part of the Re<strong>in</strong>tegration and Support Networkof governmental and non-governmental organisations which is be<strong>in</strong>g set up toprovide assistance to trafficked persons. Both UNHCR (at Vlora) and IOM willscreen women, and prepare case profiles and programmes of re<strong>in</strong>tegration.The shelter will provide counsell<strong>in</strong>g, vocational tra<strong>in</strong><strong>in</strong>g and assistance withf<strong>in</strong>d<strong>in</strong>g jobs.2.5. Legal reform and law enforcementIn January 2001, the amendments to the Penal Code <strong>in</strong> respect of traffick<strong>in</strong>gwere <strong>in</strong>troduced. The new anti-traffick<strong>in</strong>g articles (113 and 114) <strong>in</strong>creased thepunishment for traffick<strong>in</strong>g, from 10 to 25 years of imprisonment, and for traffick<strong>in</strong>g<strong>in</strong> children from 15 to 25 years. They also <strong>in</strong>troduced a new def<strong>in</strong>itionof traffick<strong>in</strong>g, which is <strong>in</strong> compliance with the Palermo Protocol’s def<strong>in</strong>ition.The current legislation provides sanctions for crim<strong>in</strong>al offences related directlyor <strong>in</strong>directly to traffick<strong>in</strong>g <strong>in</strong> human be<strong>in</strong>gs. These crim<strong>in</strong>al offences <strong>in</strong>cludetraffick<strong>in</strong>g <strong>in</strong> human be<strong>in</strong>gs, <strong>in</strong> women for prostitution and <strong>in</strong> children; illegalcross<strong>in</strong>g of the border and assistance <strong>in</strong> illegal border cross<strong>in</strong>g; exploitation ofprostitution, <strong>in</strong>clud<strong>in</strong>g <strong>in</strong>citement, <strong>in</strong>termediation or profit from prostitution;conduct<strong>in</strong>g prostitution; exploitation of prostitution <strong>in</strong> aggravated circumstances<strong>in</strong>volv<strong>in</strong>g m<strong>in</strong>ors or people <strong>in</strong>cited or forced to exercise prostitutionoutside of Albania by crim<strong>in</strong>al organisations; the ma<strong>in</strong>tenance, exploitation,f<strong>in</strong>anc<strong>in</strong>g and rent<strong>in</strong>g out of premises for prostitution; kidnapp<strong>in</strong>g a person orparticularly a child under the age of 14; removal of identification papers; andcommission of crim<strong>in</strong>al offences <strong>in</strong> collusion with armed crim<strong>in</strong>al organisations.There are also provisions for the confiscation of property used to commita crime, the deportation of foreigners <strong>in</strong>volved <strong>in</strong> crim<strong>in</strong>al offences, andfor compensation for civil damages to victims of crime.The new articles use term<strong>in</strong>ology, which is not clearly def<strong>in</strong>ed and is not used<strong>in</strong> other parts of the Penal Code. This will allow flexibility <strong>in</strong> <strong>in</strong>terpretation ofthe law, unless clear guidel<strong>in</strong>es for the judges are available to make the lawapplicable. There is no law <strong>in</strong> Albania govern<strong>in</strong>g witness protection.135
