<strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Human</strong> Be<strong>in</strong>gs<strong>in</strong> <strong>Southeastern</strong> <strong>Europe</strong>Republic ofSerbia(exclud<strong>in</strong>gKosovo)The punishment for engag<strong>in</strong>g <strong>in</strong> acts, which give someone the status of slavery,or <strong>in</strong>duc<strong>in</strong>g someone to sell themselves or others <strong>in</strong>to slavery, and/or be<strong>in</strong>volved <strong>in</strong> the movement of people for the purpose of slavery is from one to10 years imprisonment. Prostitution is prosecuted as a misdemeanour, andattracts a f<strong>in</strong>e and imprisonment of up to 30 days. Article 251 of the FRY Crim<strong>in</strong>alCode is another relevant provision, as it allows punishment of those whopromote prostitution. 92 Whilst there is provision under the Crim<strong>in</strong>al Code toprosecute traffick<strong>in</strong>g for the purposes of forced prostitution and labour, the<strong>in</strong>terpretation and implementation of this provision is unfortunately very weakwith<strong>in</strong> the judicial system.In 2000, police arrested 41 traffickers, and <strong>in</strong> 2001 (until the end of September)over 50. Traffickers were accused of smuggl<strong>in</strong>g illegal migrants, organis<strong>in</strong>gprostitution, restrict<strong>in</strong>g freedom of movement and confiscat<strong>in</strong>gdocuments, and <strong>in</strong> five cases of keep<strong>in</strong>g a person <strong>in</strong> slavery. 93Due to the lengthy legal process (2 to 5 years) and weak evidence aga<strong>in</strong>sttraffickers, only two traffickers were prosecuted <strong>in</strong> the year 2000, and theyreceived only a suspended sentence. To date, only one person has beencharged under Article 155 and he is still await<strong>in</strong>g trial.2. Current responses2.1 National Plan of Action and co-ord<strong>in</strong>ationIn April 2001, the OSCE mission <strong>in</strong> Belgrade organised a National Round Tableon traffick<strong>in</strong>g, attended by representatives of the Federal and the SerbianRepublic M<strong>in</strong>istries and representatives of the Stability Pact. As a result, theFRY government appo<strong>in</strong>ted a National Co-ord<strong>in</strong>ator on <strong>Traffick<strong>in</strong>g</strong> and a Coord<strong>in</strong>atorfor the Stability Pact Task Force on <strong>Traffick<strong>in</strong>g</strong>. 94In June 2001, the National Co-ord<strong>in</strong>ator launched the Initial Board for Combat<strong>in</strong>g<strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Human</strong> Be<strong>in</strong>gs with the support of representatives of theFederal and Republic M<strong>in</strong>istries, national NGOs, <strong>in</strong>ternational agencies andmedia. The Initial Board with the participation of the government, <strong>in</strong>ternationalagencies and NGOs formed four work<strong>in</strong>g groups: 1) Prevention and rais<strong>in</strong>gawareness; 2) Protection of the victims; 3) Law enforcement; and 4) Datacollection; through which it aimed to prepare a long term, coord<strong>in</strong>ated andmulti-discipl<strong>in</strong>ary approach to traffick<strong>in</strong>g.The work<strong>in</strong>g groups met several times to prepare plans of action <strong>in</strong> theirrespective areas, which will be comb<strong>in</strong>ed and co-ord<strong>in</strong>ated to form theNational Plan of Action (NPA) to combat traffick<strong>in</strong>g <strong>in</strong> FRY. The NPA will providea model for co-operation between the agencies and will describe areas foraction.8092.“Whoever recruits, <strong>in</strong>duces <strong>in</strong>cites or lures a female person <strong>in</strong>to prostitution or whoever <strong>in</strong>any way takes part <strong>in</strong> turn<strong>in</strong>g over a female to another for the exercise of prostitution shallbe sentenced from 3 months to 3 years. If perpetrated aga<strong>in</strong>st a m<strong>in</strong>or the offence carries asentence from 1 to 10 years”.
