<strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Human</strong> Be<strong>in</strong>gs<strong>in</strong> <strong>Southeastern</strong> <strong>Europe</strong>AIDS (UNAIDS) started a project for National Strategic Plann<strong>in</strong>g on HIV/AIDSand the implementation of prevention and <strong>in</strong>formation activities.Republic ofMoldova1.5. ProsecutionTraffickers can operate with impunity because of the prevail<strong>in</strong>g corruption andalso the often-mentioned <strong>in</strong>volvement of the authorities <strong>in</strong> organised crim<strong>in</strong>alactivities. Until recently, Moldova had no anti-traffick<strong>in</strong>g law, only a pander<strong>in</strong>glaw 47 that has limited application <strong>in</strong> cases of traffick<strong>in</strong>g.On 30 July 2001, the Parliament passed a law on additions to the Crim<strong>in</strong>alCode and Crim<strong>in</strong>al Code of Practice and <strong>in</strong>troduced Article 113 (2) “Illegal traffick<strong>in</strong>g<strong>in</strong> <strong>Human</strong> Be<strong>in</strong>gs”. 48 The law was drafted by competent <strong>in</strong>stitutions:the section of the Crim<strong>in</strong>al Police responsible for combat<strong>in</strong>g traffick<strong>in</strong>g <strong>in</strong>human be<strong>in</strong>gs at the M<strong>in</strong>istry of Internal Affairs, <strong>in</strong> co-operation with the JusticeService of the M<strong>in</strong>istry of Internal Affairs and the Police Academy; and <strong>in</strong>co-ord<strong>in</strong>ation with the M<strong>in</strong>istry of Justice, General Prosecution Office, M<strong>in</strong>istryof Labour, M<strong>in</strong>istry of Security and M<strong>in</strong>istry of Economy. The article covers allaspects of the term “traffick<strong>in</strong>g’: sale of human be<strong>in</strong>gs (with or without theirconsent); forced labour or keep<strong>in</strong>g a person <strong>in</strong> the conditions of slavery; sexualexploitation; pornographic <strong>in</strong>dustry etc., each one attract<strong>in</strong>g a prisonsentence of 5 to 25 years.However, this new law does not fully comply with the Palermo Protocol. OSCEhas issued a series of recommendations and submitted them to the LegalCommittee of the Parliament ask<strong>in</strong>g for a re-draft<strong>in</strong>g of the present legislation.As of September 2001, there were 33 cases aga<strong>in</strong>st traffickers pend<strong>in</strong>g. The15 cases prosecuted before September 2001 ended <strong>in</strong> amnesties and thereforeno one has served any prison sentence.Because of the lack of implementation of anti-traffick<strong>in</strong>g legislation and lackof witness protection law, only five women so far have been will<strong>in</strong>g to testifyaga<strong>in</strong>st traffickers, and five penal cases were <strong>in</strong>itiated as the result of theirtestimonies. Women are also not will<strong>in</strong>g to testify due to fear of be<strong>in</strong>g accusedof prostitution. Prostitution was made a crim<strong>in</strong>al offence <strong>in</strong> Moldova <strong>in</strong> 1998under Article 105-1 of the Crim<strong>in</strong>al Code and is punishable by imprisonmentfrom six months to one year. In 2000, there were 50 women charged withprostitution. 492. Current responses2.1. National Plan of Action and co-ord<strong>in</strong>ationOn 16 May 2000, the Moldavian Parliament passed a resolution, signed by thePrime M<strong>in</strong>ister, to establish the National Work<strong>in</strong>g Group on <strong>Traffick<strong>in</strong>g</strong> Issuesto co-ord<strong>in</strong>ate traffick<strong>in</strong>g prevention activities. The group was supposed toreport quarterly on prevention measures, which would <strong>in</strong>clude co-operat<strong>in</strong>gwith IOM on the implementation of their anti-traffick<strong>in</strong>g programme and<strong>in</strong>spect<strong>in</strong>g both legitimate companies and those that are fronts for organisedcrime.
