<strong>Traffick<strong>in</strong>g</strong> <strong>in</strong> <strong>Human</strong> Be<strong>in</strong>gs<strong>in</strong> <strong>Southeastern</strong> <strong>Europe</strong>among the politicians and allegedly amongst UN personnel, are the most commonlycited causes of impunity.Prosecution of traffickers is the most basic precondition for prevent<strong>in</strong>g traffick<strong>in</strong>gand stopp<strong>in</strong>g the “recycl<strong>in</strong>g” of women and girls. Otherwise, the antitraffick<strong>in</strong>gaction will stimulate illegal migration and traffick<strong>in</strong>g rather thanreduce it. Summary and conclud<strong>in</strong>g observationsAt present, governments <strong>in</strong> SEE have failed to discharge their <strong>in</strong>ternationalobligations with respect to protection and assistance for trafficked persons.Regional organised victim assistance programmes are currently implementedthrough IOM as part of their voluntary return programmes, and are thereforedesigned only for those trafficked women who would like to return home voluntarily.In some cases, NGOs are provid<strong>in</strong>g assistance on an ad hoc basis,<strong>in</strong>clud<strong>in</strong>g legal and psychological counsell<strong>in</strong>g, medical help and help <strong>in</strong> returnand re<strong>in</strong>tegration for trafficked persons through direct contact between countriesof dest<strong>in</strong>ation and orig<strong>in</strong>.There are no standard procedures for the treatment of trafficked persons andno standard protocol for the behaviour of the law enforcement agencies, <strong>in</strong>ternationalorganisations and NGOs provid<strong>in</strong>g identification, referral and assistance.Decisions about the status of trafficked persons are very subjective andthe support they receive is <strong>in</strong>adequate. There is no monitor<strong>in</strong>g or evaluationof assistance and re<strong>in</strong>tegration programmes. There are also neither specialprocedures or programmes for the girls under 18 nor any HIV/AIDS/STIs preventionand protection programmes <strong>in</strong>corporated <strong>in</strong>to the assistance, returnand re<strong>in</strong>tegration activities.There is no comprehensive and systematic referral system. Women arresteddur<strong>in</strong>g bar raids or who ask for help from the local police to return to theircountries of orig<strong>in</strong> and are judged by the police 167 to be trafficked, arereferred to IOM or UNHCR. If the police decide that a woman came to thecountry voluntarily or does not want to be repatriated, she can be charged167.In BiH and Kosovo, <strong>in</strong>ternational police.147
