Annexure - 4as on fulfillment <strong>of</strong> commitments as set out in Annexure 'A'.5. The State Government shall also release their share <strong>of</strong> funds in proportion to the fund releasesmade by Government <strong>of</strong> India from time to time.6. The State Government will constitute a Project Review Committee headed by the Secretary <strong>of</strong>the Nodal Department for reviewing the progress <strong>of</strong> the project on quarterly basis. Arepresentative <strong>of</strong> MoEF will be a member <strong>of</strong> this Committee.7. The State Government will appoint the implementing agency for the projects and theimplementing agency will coordinate with the ULBs as well as other agencies to ensure synergybetween programs like JNNURM/UIDSSMT and approved components under the NRCP/NLCP.8. The State Government and the ULB will be responsible for implementing, monitoring andreporting under the program.9. The State Government shall be responsible for necessary coordination mechanism betweenthe Implementing Agency and the ULB.10. The State Government will ensure that the physical progress, expenditure reports andUtilisation Certificates are furnished by the Implementing Agency to MoEF on a quarterly basis.In case the Implementing Agency fails to submit such a report, further instalment <strong>of</strong> GoI's sharemay be withheld, until such submission.11. MoEF or any agency nominated by it, may undertake periodic site visits to ascertain theprogress <strong>of</strong> the ongoing projects and compliance <strong>of</strong> the conditions in the Checklist.12. The responsibility <strong>of</strong> operation and maintenance will be with the ULB/ maintenance agency.The ULB will submit a report regarding the mechanism for raising resources for the operationand maintenance <strong>of</strong> assets and will provide details <strong>of</strong> the same while submitting the projectreport. These may include instruments like user charges, property tax, sanitation charges orinnovative PPP options. Schemes will be sanctioned contingent upon evaluation <strong>of</strong> the O&MPlans submitted by the ULB/implementing agency. Subsequent fund releases would dependon satisfactory progress <strong>of</strong> implementation <strong>of</strong> O & M plan.13. The State Government and ULB will be responsible for proper O &M <strong>of</strong> existing facilities likesewage treatment plants, sewage pumping stations, low cost sanitation, etc.14. State Government and the Implementing Agency shall institute mechanism to ensure timelycompletion <strong>of</strong> projects undertaken under NRCP/NLCP15. The cost overrun due to delay <strong>of</strong> the project or cost escalation <strong>of</strong> different items shall be borneby the State Government/ULB.16. The implementation period can be extended, if so required, due to change in scope <strong>of</strong> work orother site specific condition. The decision in the matter <strong>of</strong> extension <strong>of</strong> time shall be at thediscretion <strong>of</strong> MoEF.17. MoEF will set up the mechanism for concurrent evaluation and monitoring <strong>of</strong> the project.18. The State Government will provide the certification <strong>of</strong> project completion <strong>of</strong> the works.19. In case <strong>of</strong> dispute between the parties, the matter will be resolved through mutual discussion.20. In case <strong>of</strong> any breach regarding the terms and conditions <strong>of</strong> the MoA, MoEF shall be entitled towithhold release <strong>of</strong> subsequent installments <strong>of</strong> the grant.21. The funds routed through MOA mechanism will be liable to statutory audit by the Controllerand Auditor General <strong>of</strong> India.22. This Memorandum <strong>of</strong> Agreement will take effect from the date <strong>of</strong> signing and would remainoperative unless terminated by parties concerned by mutual consent.120
