No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005licence or, by notice in writing, suspend, revoke or refuse to renew alicence on the grounds stated in the notice.(2) Application for a licence under this section shall be in theprescribed form.(3) A licence issued under subsection (1) shall be subject to thepayment of the prescribed annual fee and shall expire on the thirty-firstday of December in each year.(4) The Commissioner may require the person applying for a licenceto furnish such security as the Commissioner may think appropriate asa condition to the grant of the licence and the Commissioner may, atany time, require a licensee to furnish a new security in a differentamount or on different terms.(5) Premises shall not be used for manufacturing under bond unlessthere is a valid licence for that purpose in relation to such premises.(6) A person who uses or permits premises to be used formanufacturing under bond without a licence, or a licensee who uses orpermits his bonded factory to be used in contravention of the terms ofhis or her licence commits an offence and shall be liable on convictionto a fine not exceeding five thousand dollars or to imprisonment for aterm not exceeding three years or to both; and any goods in respect towhich an offence has been committed shall be liable to forfeiture.Entry ofpremisesasbondedfactories161.-(1) A licensee shall, before commencing to manufacture underbond, make entry in the prescribed form and in the prescribed mannerof each building, room, place and item of plant in his or her factorywhich he or she proposes to use in the manufacture or storage of rawmaterials or manufactured goods; and, in each entry, he or she shallspecify the purpose for which each building, room, place or item ofplant is to be used.(2) A licensee shall not, in the course of manufacturinggoods underbond -(a) make use of a building, room, place or item of plant inrelation to which entry is required under this section unless108
