No. 1 East African Community Customs Management 2005(d) affect a penalty, forfeiture or punishment incurred in respectof an offence committed against a written law of a PartnerState in force at the commencement; or(e) affect an investigation, legal proceeding or remedy inrespect of a right, privilege, obligation, liability, penalty,forfeiture or punishment, and any such investigation, legalproceeding or remedy may be instituted, continued orenforced, and any such penalty, forfeiture or punishmentmay be imposed as if this Act had not been passed;(f)affect the employment or appointment of any person to theservice of Customs subsisting at the commencement of thisAct;(g) affect any contract, undertaking or obligation entered into,made or assumed under a written law in force in a PartnerState at the time of the commencement.Act totakeprecedence253. This Act shall take precedence over the Partner States' lawswith respect to any matter to which its provisions relate.154
