No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(b) by cash deposit; or(c) partly by bond and partly by cash deposit.(2) Where any security is required to be given under this <strong>Act</strong> for anyparticular purpose then such security may, with the approval of theCommissioner be given to cover any other transactions which theperson giving the security may enter into within such period as theCommissioner may approve.(3) All bonds required to be given under this <strong>Act</strong> shall be so framedthat the person giving the bond, and any surety thereto, is bound to theCommissioner for the due performance of the conditions of that bond;and any such bond may, unless sooner discharged by the dueperformance of the conditions thereof, be discharged by theCommissioner on the expiration of three years from the date thereof,but without prejudice to the right of the Commissioner to require freshsecurity.(4) Where any bond given under this <strong>Act</strong> is discharged, then theCommissioner shall cause such bond to be cancelled and anendorsement to that effect made thereon.Provisionsrelatingtosureties108.-(1) Without prejudice to any rights of a surety to any bondgiven under this <strong>Act</strong> against the person for whom he or she is surety, asurety shall, for all the purposes of any bond, be deemed to be theprincipal debtor and accordingly the surety shall not be discharged, norhis or her liability affected, by the giving of time for payment, or bythe omission to enforce the bond for any breach of any conditionsthereof, or by any other act or omission which would not havedischarged the bond if he or she had been the principal debtor.(2) If a person being a surety-(a) dies; or(b) becomes bankrupt or enters into any arrangement orcomposition with, or for the benefit of, his or her creditors;or80
