No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(b) with the permission of the proper officer and subject to suchconditions as he or she may impose, goods reported forre-exportation by another aircraft or vessel may beunloaded into any other aircraft or vessel pendingre-exportation;(3) All goods, which have been unloaded or landed, shall beconveyed to a <strong>Customs</strong> area and, if the proper officer so requires, shallbe deposited in a transit shed or in a <strong>Customs</strong> warehouse:Provided that such goods as the proper officer may consider tobe unsuited for storage in a transit shed or a <strong>Customs</strong> warehouseshall be deposited in such other place as the proper officer maydirect, and thereupon such other place shall, for the purpose ofsuch deposit, be deemed to be a transit shed;(4) Goods shall not be removed from any part of a <strong>Customs</strong> area orfrom a transit shed or a <strong>Customs</strong> warehouse unless such goods havebeen duly reported and entered and authority for their removal ordelivery has been given by the proper officer:Provided that the proper officer may, if he or she considers itnecessary, direct the agent of any aircraft or vessel from whichgoods have been landed into any transit shed or <strong>Customs</strong>warehouse to remove such goods to some other place (whichother place shall, for such purpose, be deemed to be a transitshed) selected by such proper officer and, if the agent fails toremove the goods when called upon, the proper officer may havethem removed at the risk and expense of such agent;(5) All goods entered for warehousing shall be removed by theimporter by such routes, in such manner, and within such time, as theproper officer may direct to the warehouse for which they were enteredand shall be delivered into the custody of the person in charge of thewarehouse:Provided that, if the proper officer so requires, the owner shallfirst enter into a bond for the due warehousing of the goods.(6) A person who contravenes this section, or any of the conditionswhich may have been imposed by, or any of the directions which mayhave been given by, the proper officer commits an offence and anygoods in respect of which such offence has been committed shall beliable to forfeiture.38
