No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(3) A warehouse keeper who takes, substitutes, causes or permitsany goods in a bonded warehouse to be taken or substituted commitsan offence and shall be liable to a fine of twenty-five percent of thedutiable value of the goods substituted or taken.68. Where any goods are deposited in a Government warehouse,then they shall be subject to such rent and other charges as may beprescribed or as may be provided for in this <strong>Act</strong>; and, if such rent andother charges are not paid to the proper officer when lawfullydemanded, the goods in respect of which such rent and other chargesare due may be sold, and the proceeds thereof applied, in accordancewith section 42.69.-(1) Where any goods are deposited in a Government warehouse,the proper officer may-(a) remove, at the expense of the <strong>Customs</strong>, such goods fromthat warehouse to another Government warehouse;Goods inGovernmentwarehouseliable torent, etc.Removal,etc., ofgoods inGovernment warehouse(b) perform, in relation to such goods and at the expense of theowner thereof, all such acts as he or she may considerreasonably necessary for the proper custody andpreservation of such goods:Provided that the proper officer shall not, save wherehe or she considers immediate action necessary, performany such act until twenty-four hours after the owner ofsuch goods has been notified that any such act isnecessary;(c) by notice inform the owners of the goods that it is proposedto close the warehouse at the end of such period, not beingless than three months from the date of such notice, as maybe specified in the notice;(2) The Commissioner may prescribe the manner in which thegoods deposited in a Government warehouse may be dealt with upona warehouse being closed under subsection (1).59
