No. 1 East African Community Customs Management 2005(h) goods which have been declared for or are intended fortransfer to another Partner State;(i) seized goods.(2) Where any goods are subject to Customs control, then-(a) any officer may at any time examine such goods;(b) except with the authority of the Commissioner or inaccordance with this Act, no person shall interfere in anyway with such goods.(3) Where any goods are subject to Customs control, then theCommissioner may permit the owner of such goods to abandon themto the Customs; and on such abandonment such goods may, at theexpense of the owner thereof, be destroyed or otherwise disposed of insuch manner as the Commissioner may direct and the duty thereonshall be remitted or refunded, as the case may be.(4) A person who contravenes subsection (2)(b) commits an offenceand shall be liable on conviction to a fine not exceeding one thousanddollars or to imprisonment for a term not exceeding three years, or bothand any goods in respect of which such offence has been committedshall be liable to forfeiture.Liabilityfor loss,etc.,throughnegligenceofofficer17. Where any loss or damage is occasioned to any goods subject toCustoms control through the wilful or negligent act of a Commissioneror an officer, an action shall lie against the Commissioner or suchofficer in respect thereof.PART IIIIMPORTATIONProhibited and Restricted ImportProhibitedandrestrictedimports18.- (1) The goods specified in Part A of the Second Schedule areprohibited goods and the importation thereof is prohibited.(2) The goods specified in Part B of the Second Schedule arerestricted goods and the importation thereof, save in accordance withany conditions regulating their importation, is prohibited.28
