No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(4) A person who contravenes this section commits an offence andany goods in respect of which such offence has been committed shallbe liable to forfeiture.Clearance by Pipeline32.-(1) The nature and quantities of goods imported or exportedthrough a pipeline shall be recorded and reported by the operator of thepipeline in such manner as the Commissioner may direct.Operatorofpipelineto report(2) For the purpose of keeping records and making reports referredto in subsection (1), the operator shall at his or her own expense,provide such apparatus and appliances as the Commissioner mayspecifyUnloading and Removal of Cargo33.-(1) Save with the written permission of the proper officer andsubject to such conditions as he or she may impose-Unloading,etc.(a) goods shall not be unloaded from any aircraft or vesselarriving from a foreign port unless such goods have beenduly entered;(b) goods shall not be unloaded or removed from any aircraft orvessel arriving from a foreign port at any time whatsoeverexcept as prescribed by the Commissioner;(c) goods shall not be unloaded from any aircraft or vesselarriving from a foreign port except at an approved place ofunloading or at a sufferance wharf:(2) Notwithstanding subsection (1)-(a) goods may be unloaded from any such aircraft or vessel intoanother vessel in order to be landed; and in any such casesuch goods shall be taken directly to and landed withoutdelay at an approved place of unloading or at a sufferancewharf;37
