No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(f) goods put on board any vessel to be loaded on to any aircraftor other vessel departing to a foreign port shall be so loadedwithin the limits of the port.(2) A person who contravenes this section, or any of the conditionswhich may have been imposed by the proper officer, commits anoffence and any goods in respect of which such offence has beencommitted shall be liable to forfeiture.76.-(1) Notwithstanding section 75, the proper officer may, subjectto any regulations, permit-(a) goods which are the bona fide personal baggage of thepassenger, or members of the crew, of any aircraft or vesselto be put on board such aircraft or vessel and exportedwithout entry;Provisionsrelatingtopersonalbaggage(b) goods intended for sale or delivery to passengers, ormembers of the crew, of any aircraft or vessel to be put onboard such aircraft or vessel, subject to such conditions ashe or she may impose, without entry;(c) mail bags and postal articles in the course of transmission bypost to be put on board and exported without entry;(d) goods to be put on board any aircraft or vessel departing toa foreign port without entry subject to an application beingmade by the owner on the prescribed form and in theprescribed manner and to an undertaking being given by theowner of such goods to furnish the necessary entry withinforty-eight hours, or such further time as the proper officermay specify, of the departure of the aircraft or vessel and tosuch security, if any, being given by such owner for the duepayment of any export duties as the proper officer mayconsider appropriate.(2) A person who-(a) contravenes any conditions imposed under subsection (1)(b); or63
