No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(4) An owner or user of a private railway siding or any other personshall not receive railway wagons containing goods subject to customscontrol into a private railway siding unless he or she has been grantedpermission in writing by the Commissioner.(5) A person who contravenes the provisions of this sectioncommits an offence and any goods in respect of which such offencehas been committed shall be liable to forfeiture.Arrivaloverlandotherwisethan byvehicle31.-(1) A person arriving overland in the Partner States from aforeign place, if he or she has any goods in his or her possession, shall,before disposing of the goods-(a) report his or her arrival to the officer stationed at the<strong>Customs</strong> house nearest to the point at which he or shecrossed the frontier;(b) furnish on the prescribed form such information as may berequired concerning the goods;(c) make and subscribe a declaration as to the truth of allparticulars contained in the form;(d) fully and immediately answer all relevant questions put tohim or her by the proper officer;(e) produce all consignment notes or other relevant documentsdemanded of him or her by the proper officer;(f) save as otherwise provided in the <strong>Customs</strong> laws, make dueentry of any such goods.(2) Goods to which this section applies shall not be removed fromthe <strong>Customs</strong> area until after due entry thereof has been made or untilpermission for removal has been granted by the proper officer.(3) The Commissioner may, subject to such conditions as he or shemay specify, exempt any person or class of persons from theprovisions of this section.36
