No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005who contravenes any conditions imposed by the Commissioner underthis section commits an offence and shall be liable to a fine notexceeding one thousand five hundred dollars and any goods in respectof which such offence has been committed shall be liable to forfeiture,and the aircraft or vessel in relation to which such offence has beencommitted may be seized and detained until the fine is paid.Entryoutwardsofaircraft,etc.,carryinggoodscoastwiseCoastingvessel,etc., nottodeviatefromvoyage103. The Commissioner may, subject to such conditions as he or shemay impose, permit the master or agent of any aircraft or vesselcarrying any goods coastwise to enter outwards such aircraft or vesseland to enter any goods carried coastwise therein for exportationwithout discharging such goods.104. The master or agent of any coasting aircraft or coastingvessel-(a) which deviates from its voyage, unless forced to do so bycircumstances beyond the control of the master or agent, theproof whereof shall lie on the master or agent; or(b) which, having deviated from its voyage or having taken onboard any wreck or other goods or discharged any goods inthe course of a voyage from one part of the Partner States toanother, does not forthwith proceed directly to the nearestport in the Partner States and explain the circumstancesthereof to the satisfaction of the proper officer and deliverany such wreck or other goods taken on board to theproper officer,commits an offence and any goods in respect of which such offencehas been committed shall be liable to forfeiture, and the aircraft or vesselin relation to which such offence has been committed may beseized and detained until the fine is paid.Examinationofcoastingvesselandgoods105.-(1) An officer may go on board any coasting aircraft orcoasting vessel in any port or place in a Partner State or at any periodof the voyage of such aircraft or vessel, and search such aircraft orvessel and examine all goods on board such aircraft or vessel.78
