No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005may refuse delivery therefrom until he or she is satisfied that all duties,expenses, rent, freight and other charges due in respect of such goodshave been paid.Goodsdeemedto be in<strong>Customs</strong>warehouse43.-(1) Where under this <strong>Act</strong> any goods are required to bedeposited in a <strong>Customs</strong> warehouse, the proper officer may, decide thatit is undesirable or inconvenient to deposit such goods in a <strong>Customs</strong>warehouse and direct that such goods shall be deposited in some otherplace; and thereupon such goods shall for all purposes be deemed tohave been deposited in a <strong>Customs</strong> warehouse as from the time that theyare required to be deposited.(2) Where any goods are deemed to have been deposited in a<strong>Customs</strong> warehouse then such goods shall, in addition to the rent andother charges to which they are liable under section 42, be chargeablewith such expenses incurred in the securing, guarding, and removing,of them as the proper officer may consider reasonable; and neither theCommissioner nor any officer shall be liable for the loss of or damageto such goods which may be occasioned by reason of their beingdeposited and dealt withPassenger ClearanceDisembarkationofpersons44.-(1) A person shall not disembark from any aircraft or vesselexcept at a place appointed in accordance with section 11 of this <strong>Act</strong>.(2) The following persons on landing at any port or place from anaircraft or vessel which has arrived from or called at a foreign portshall, subject to section 46 proceed forthwith to the baggage room orother place set aside for the examination of baggage and there remainuntil they receive the permission of the proper officer to leave thatroom or other place-(a) any person who is disembarking at that port or place;(b) any person, including any person who is returning ashore,who has any uncustomed goods in his possession, whetherupon his person or in his baggage;(c) the crew of an aircraft or vessel who are leaving that aircraft44
