No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005which have been put on board any aircraft or vessel for exportation toany place to produce, within such time as the proper officer mayconsider reasonable, a certificate from the customs authorities at theport of discharge of the due discharge thereat of the goods accordingto the export entry; and if owner fails to produce the certificate, or ifthe certificate does not show that the goods have been duly dischargedthereat according to the export entry, and the owner fails to account forany such goods to the satisfaction of the proper officer, then theproper officer may refuse to allow the owner to enter for export and toexport any other goods in respect of which security may be requiredunder this section.(4) Where any bonded goods -(a) are short-shipped, the owner thereof shall so notify theproper officer within twenty-four hours, or such furthertime as the proper officer may allow, of the departure of theaircraft or vessel;(b) have been removed from a warehouse for delivery on boardany aircraft or vessel but are not put on board such aircraftor vessel, the owner shall forthwith enter the goods forwarehousing, or for exportation, or for use as stores foraircraft or vessels.(5) Where any bonded goods are brought to any <strong>Customs</strong> airport,<strong>Customs</strong> area, or other place, to be put on board any aircraft or vesseland, on examination by the proper officer, are found-(a) not to agree with the particulars of the entry;(b) being goods under duty drawback, not to be goods entitledto drawback, the owner of such goods commits an offenceand any goods in respect of which such offence has beencommitted shall be liable to forfeiture.(6) An owner who-(a) contravenes any condition imposed on him or her under thissection in respect of any bonded goods; or65
