No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005Stowageand storageofgoods inbondedwarehouse65.-(1) The proper officer may direct in what parts or divisions ofany bonded warehouse and in what manner any goods shall bedeposited therein.(2) Subject to section 51, where any goods have been warehousedin a bonded warehouse, then, except with the approval of the properofficer, such goods shall not be moved or interfered with in any way,nor shall any alteration be made in the marks or numbers of anypackage.(3) A warehouse keeper who contravenes, or who causes or permitsa contravention of, this section commits an offence and shall be liableto a fine not exceeding one thousand dollars, and any goods in respectof which any offence under subsection (2) has been committed shall beliable on conviction to forfeiture.Removalof goodsfrom privatetogeneralwarehouse66.-(1) Where the warehouse keeper of a private bonded warehousecontravenes any of the provisions of this <strong>Act</strong>, the proper officer mayrequire him or her within such time as the proper officer may direct, toremove all or any of the goods warehoused in such private bondedwarehouse to a general bonded warehouse at the expense of thewarehouse keeper or to enter and deliver them for home consumption,for exportation, or for use as stores for aircraft or vessels(2) Where any warehouse keeper contravenes any requirementgiven under subsection (1), the proper officer may cause such goods tobe taken to a <strong>Customs</strong> warehouse and thereupon such goods shall bedealt with in accordance with section 42.Warehousekeeper toproducegoodsdeposited67.-(1) A warehouse keeper shall, on request, produce to the properofficer all goods deposited in his or her bonded warehouse.(2) A warehouse keeper who contravenes subsection (1), in theabsence of satisfactory explanation to the proper officer, commits anoffence and shall be liable on conviction to a fine of ten percent of thedutiable value in respect of each package not so produced and, inaddition, the warehouse keeper shall forthwith pay the duties in respectof each such package.58
