No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005and signed by the proper officer, shall constitute the grant of transirefor the carriage of the goods specified therein and shall, in the case ofa coasting aircraft or coasting vessel, be the certificate of clearance forsuch aircraft or vessel for the coastwise voyage.(3) A master or agent who contravenes this section, or who deliversan account of which any of the particulars contained therein is false,commits an offence and shall be liable on conviction to a fine notexceeding five hundred dollars and the coasting aircraft or coastingvessel in relation to which such offence has been committed may beseized and detained until the fine is paid.101.-(1) The master or agent of any aircraft or vessel arriving at aport or place within a Partner State carrying goods coastwise or goodsfor transfer-(a) shall forthwith deliver the transire to the proper officer ofthat port or place;Transireto bedeliveredonarrival(b) shall not, save with the permission of the proper officer andsubject to such conditions as the proper officer may impose,permit any goods to be unloaded before the delivery of thetransire:Provided that in the case of a vessel of two hundred andfifty tons register or more, such transire may be deliveredwithin twenty-four hours of arrival and the goods may beunloaded therefrom before the delivery of such transire.(2) A master or agent who contravenes this section commits anoffence and shall be liable to a fine not exceeding five hundred dollarsand any goods in respect of which such offence has been committedshall be liable to forfeiture, and the coasting aircraft or coasting vesselin relation to which such offence has been committed may be seizedand detained until the fine is paid.102. -(1) Notwithstanding any provision of this <strong>Act</strong>, theCommissioner may permit any coasting aircraft or coasting vessel tobe loaded, unloaded, and cleared, subject to such conditions as theCommissioner may in any particular case impose.(2) The master or agent of any coasting aircraft or coasting vesselPower ofCommissioner tovaryprocedure77
