No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(ii) that any goods were staved, broken, destroyed, orthrown overboard, or were so staved, broken,destroyed or thrown overboard for the purpose ofpreventing the seizure or the securing of the goodsafter seizure;(iii) that any act was done within the limits of any port orat, in, or over, any part of a Partner State;(iv) that the Commissioner, or proper officer is or is notsatisfied as to any matter as to which it is required tobe satisfied under this <strong>Act</strong>;(v) that the Commissioner has directed or requested anyproceedings under this <strong>Act</strong> to be instituted,shall be prima facie evidence of such fact;(c) a certificate purporting to be signed by the GovernmentAnalyst, the Government Chemist or any designatedlaboratory of any Partner State shall be admissible inevidence and shall be prima facie evidence of the mattersrecorded in the certificate;(d) the production of any document purporting to be signed orissued by the Council, the Commissioner, or any person inthe service of the <strong>Customs</strong> or the Government of anyPartner State, shall be prima facie evidence that suchdocument was so signed or issued;(e) a copy, certified under the hand of the responsible officer ofany declaration in any book or document required to be keptfor the purposes of the <strong>Customs</strong> laws shall be admissible inevidence and shall be prima facie evidence of suchdeclaration and of the matters recorded in the book ordocument;(f) any certificate, official report or other document purportingto be certified under the hand and seal or stamp of the officeof a principal officer of <strong>Customs</strong> or of any other competentauthority in a foreign country and produced by the139
