No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005THE EAST AFRICAN COMMUNITYNO. 1 OF 2005Date of assent: 31 st December, <strong>2004</strong>Date of commencement: 1 st January, 2005An <strong>Act</strong> of the <strong>Community</strong> to make provisions for the managementand administration of <strong>Customs</strong> and for related matters.PART IPRELIMINARY PROVISIONS1.-(1) This <strong>Act</strong> may be cited as the <strong>East</strong> <strong>African</strong> <strong>Community</strong><strong>Customs</strong> <strong>Management</strong> <strong>Act</strong>, <strong>2004</strong>.(2) This <strong>Act</strong> shall apply to the Partner States.(3) This <strong>Act</strong> shall commence on the date to be appointed by theCouncil.2. -(1) In this <strong>Act</strong>, unless the context otherwise requires-"agent" in relation to an aircraft, vehicle or vessel, includes any personwho notifies the proper officer in writing that he or she intends toact as the agent and who, or on whose behalf any person authorisedby him or her, signs any document required or authorised by this <strong>Act</strong>to be signed by an agent: Provided that the owner of any aircraft,vehicle or vessel, if resident or represented in a Partner State, shalleither himself or herself or through his or her representative bedeemed to be the agent for all the purposes of this <strong>Act</strong> if no suchagent is appointed;Shorttitle,applicationandcommencementInterpretation13
