No. 1 East African Community Customs Management 2005(c) the time of importation of goods shall be deemed to be thetime at which the goods come within the boundaries of thePartner States;(d) the time of exportation of goods shall be deemed to be(i) thetime at which the carrying aircraft or vessel departs from itsfinal position, anchorage or berth at the port or placewithin boundaries of the Partner State at which the goodsare shipped for exportation; in the case of goods exportedoverland, the time at which the goods pass across theboundaries of the Partner States;(e) where any aircraft or vessel arrives within a Partner Statefrom any foreign port, in relation to each port or placewithin a Partner State at which such aircraft or vessel mayarrive, such aircraft or vessel shall be deemed to havearrived from a foreign port;(f) where any aircraft or vessel proposes to depart from aPartner State to any foreign port, then, in relation to eachport or place within a Partner State from which such aircraftor vessel may depart, such aircraft or vessel shall be deemedto be departing therefrom to a foreign port;(g) any reference to a Partner State, or any of the neighbouringPartner States, shall be deemed to include a reference to theterritorial waters thereof;(h) every act, matter, or thing, required or authorised by this Actto be done or performed by, with, to, or before, theCommissioner, if done or performed by, with, to, or before,any officer appointed by the Commissioner for suchpurpose, shall be deemed to be done or performed by, with,to, or before, the Commissioner;(i) every person employed on any duty or service relating to theCustoms by order, or with the concurrence, of theCommissioner shall be deemed to be the proper officer forthat duty or service; and every act required by this Act atany time to be done by, with, to, or before, any particular19
