No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(4) Where any goods have not been entered and delivered inaccordance with subsection (3), the proper officer may cause suchgoods to be taken to a <strong>Customs</strong> warehouse and thereupon such goodsshall be dealt with in accordance with section 42.64.-(1) A warehouse keeper shall-(a) provide such office accommodation and weights, scales,measures, and other facilities, for examining and takingaccount of goods and for securing them as the properofficer may require;Warehousekeeper toprovidefacilities(b) keep a record of all goods warehoused and shall keep suchrecord at all times available for examination by the properofficer; keep a record of all goods warehoused therein andshall keep such record at all times available for examinationby the proper officer;(c) stack and arrange the goods in the bonded warehouse so asto permit reasonable access to and examination of everypackage at all times;(d) provide all necessary labour and materials for the storing,examining, packing, marking, coopering, weighing, andtaking stock, of the warehoused goods whenever the properofficer so requires;(e) maintain such records and accounts relating to goods and theoperations of a refinery, in such form and manner, as theproper officer shall require; and keep such records andaccounts at all times available for examination by theproper officer.(2) Where any warehouse keeper contravenes this section, theCommissioner may direct that no other goods shall be warehoused bysuch warehouse keeper until such warehouse keeper has, in theopinion of the Commissioner, complied with this section.(3) A warehouse keeper who contravenes any of the provisions ofthis section or any direction given by the Commissioner under thissection commits an offence and shall be liable on conviction to a finenot exceeding one thousand dollars.57
