No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005(b) contravenes subsection (4), commits an offence and anygoods in respect of which such offence has been committedshall be liable to forfeiture.(7) Where any master contravenes, or causes or permits thecontravention of, subsection (2), he commits an offence and shall beliable on conviction to a fine not exceeding five thousand dollars or toimprisonment for a term not exceeding three years and any goods inrespect of which such offence has been committed shall be liable toforfeiture.Storesforaircraftandvessels79.-(1) The proper officer may, on application being made on theprescribed form and in the prescribed manner by the master or agent ofany aircraft or vessel departing to a foreign port, permit any goods tobe put on board any such aircraft or vessel, for use as stores subject tothe payment of any export duty and to such conditions as the properofficer may deem fit.(2) A person who puts, or causes or permits to be put, any goods onboard any aircraft or vessel for use as stores in contravention of thissection, or of any conditions imposed by the proper officer, commitsan offence and any goods in respect of which such an offence has beencommitted shall be liable to forfeiture.Shortshipmentof nonbondedgoods80.-(1) Where any goods, other than bonded goods within themeaning of section 78, are entered for exportation and such goods arenot exported in the aircraft or vessel for which they were entered or areshort-shipped, the owner of the vessel or aircraft in which the goodsare intended to be exported shall notify the proper officer withinforty-eight hours, or such further time as the proper officer may allow,of the departure of the aircraft or vessel.(2) An owner who contravenes this section commits an offence andshall be liable on conviction to a fine not exceeding five hundreddollars.Exportgoodsstored atrisk ofowner81. Where any goods are, with the permission of the proper officer,stored in a transit shed or a <strong>Customs</strong> area pending exportation ortranshipment or while in transit-66
