No. 1 <strong>East</strong> <strong>African</strong> <strong>Community</strong> <strong>Customs</strong> <strong>Management</strong> 2005Provisionsrelatingto mail,personalbaggage,etc.36.-(1) Notwithstanding sections 33 and 34-(a) mail bags and postal articles in the course of transmissionby post may be unloaded and delivered to an officer of thePost Office without entry;(b) goods which are the bona fide personal baggage of thepassengers, or members of the crew, of any aircraft orvessel may, subject to the provisions of any regulations, beunloaded and delivered to such persons without entry;(c) human remains may be released without entry;(d) diplomatic bags may be released without entry;(e) the proper officer may permit the unloading and delivery tothe owner of any bullion, currency notes, coin, or perishablegoods, without entry subject to an undertaking being givenby such owner to furnish the necessary entry withinforty-eight hours of the time of delivery.(2) An owner who contravenes any undertaking given undersubsection (1) (e) commits an offence and shall be liable to a fine notexceeding five hundred dollars.Entry inabsenceof documents37.-(1) Where the owner of any goods is, by reason of the absenceof any, or of any sufficient, documents or information concerningthem, unable to furnish full particulars of such goods, he or she shallmake and subscribe a declaration on the prescribed form to that effect,and thereupon the proper officer may permit the owner to examinesuch goods in his or her presence.(2) Upon such examination having been made the proper officermay, subject to section 38, permit the owner to enter such goods forhome consumption, or for warehousing, if he or she is satisfied that thedescription of the goods for tariff and statistical purposes is correctlymade in such entry, and also-(a) in the case of goods liable to duty ad valorem, that the valuedeclared on the entry is in accordance with the FourthSchedule; and
