allied to educational initiatives and relevance; and availability of a responsive<br />

and dependable legal and tax regime.<br />

9. Part of the reason for the lack of broader knowledge of the trustees’ role may<br />

be due to the vagaries of legal translations. Both the term “trustee” and the “trust”<br />

concept present difficulties.<br />

In the anatolia lexicon, “trustees” is translated as “ephors,” since apparently<br />

the school first came to Greece. “Ephors” hints at oversight, but it is legally<br />

vague. It refers to several different types of officials with different powers in diverse<br />

organizations and mutates the trustee role. In ancient sparta the ephors were<br />

the five overseers alongside the two Kings (herodotus,“The Constitution of Spar -<br />

ta”).today, the term is used by both government and private associations, ranging<br />

from tax and archaeology officials to the Boy scouts. In my view, “Διοικητικό<br />

Συμβούλιο” - or “Δ.Σ.” (“board of directors,” and individually, “member of...”)<br />

is the better translation. We overlook that exact term, “Board of Directors,” is<br />

used in anatolia’s act of Incorporation as a synonym for “Board of Trustees.”<br />

for the comparative law oriented, “trusts” are unknown in Greek law as these<br />

legal entities are exclusive to the common law. trusts cannot be created under<br />

Greek domestic law since the anglo-american concept of dividing title into legal<br />

title and equitable interest is unique. the civil law, generally, accomplishes similar<br />

ends through contracts and wills, public policy permitting. athanassios<br />

according to Prof. anastasia Grammaticaki-alexiou, the term for a “trust” in<br />

Greek is “εμπίστευμα” K and K 10 II h 2. (In this Presentation, “trust” is used in<br />

its ordinary sense to refer to public trust and entrustment.)<br />
