Zone 3: Also termed the “outer zone,” it extends a<br />

minimum of 20 feet immediately from the outer edge<br />

of Zone 2. This zone prevents encroachment into the<br />

riparian buffer area, filters runoff from adjacent land,<br />

and encourages sheet flow of runoff into the buffer. The<br />

vegetative target <strong>for</strong> the outer zone is native woody and<br />

herbaceous vegetation to increase the total width of the<br />

buffer; native grasses and <strong>for</strong>bs are acceptable. (HRWC<br />

Community planning and riparian buffers<br />

Numerous tools exist at the community level to protect<br />

riparian buffers, including ordinances, integrating<br />

buffers into plans, and public education.<br />

Community buffer regulations<br />

To effectively manage riparian buffer areas, a community<br />

must properly plan <strong>for</strong> these resources. Some<br />

<strong>Michigan</strong> communities have riparian buffer ordinances<br />

that explicitly regulate these areas. Typical components<br />

of a riparian ordinance include:<br />

• Exemptions,<br />

• Width requirements,<br />

• Permitted and prohibited uses within the riparian<br />

buffer,<br />

• Maintenance requirements,<br />

• Waivers and variances, and<br />

• Maintenance and construction of utilities and public<br />

roads along the stream corridor.<br />

Natural features setback standards establish a minimum<br />

setback (buffer width) from natural features to prevent<br />

physical harm or destruction of the feature. These standards<br />

recognize the relationship between terrestrial and<br />

aquatic ecosystems and should be applied to both lakes<br />

and rivers. Each community establishes buffer width<br />

standards at their discretion.<br />

In general, the wider the buffer, the greater the number<br />

of ecological functions the riparian zone will provide.<br />

Communities may choose to establish fixed or variable<br />

width buffers or a combination of the two. (Oakland<br />

Integrating buffer protection into plans<br />

In addition to implementing a riparian buffer ordinance,<br />

communities can include riparian buffer area protection<br />

in the following planning tools:<br />

• Community master plans,<br />

• Park and recreation plans, and<br />

• Subdivision and land development ordinances.<br />

Key planning elements of a local<br />

riparian area protection program*<br />

• Provide ample setbacks <strong>for</strong> sanitary facilities on buffer<br />

areas.<br />

• The wider the riparian buffer, the greater the water<br />

quality protection and habitat value of the area.<br />

• Establish setbacks from rivers and streams.<br />

• Regulate road placement adjacent to the riparian<br />

buffer area.<br />

• Restrict clearing, construction, and development<br />

within the 100-year floodplain.<br />

• Zone areas adjacent to riparian buffer areas <strong>for</strong> low<br />

intensity development.<br />

• Establish minimum lot size, frontage, and width<br />

requirements.<br />

• Include reference to floodplain, soil, and sedimentation<br />

controls administered by other agencies in<br />

riparian regulations.<br />

• Screen new structures with native vegetation.<br />

• Limit industrial use along riparian corridors and<br />

regulate through special use permits subject to predesignated<br />

standards.<br />

• Limit the amount of impervious surfaces allowed<br />

adjacent to buffer area.<br />

• Clearly outline appropriate and inappropriate use of<br />

riparian buffer areas.<br />

• Promote intergovernmental coordination of regulations<br />

among communities along the river corridor.<br />
