significantly sub-average general intellectual functioning existing concurrently with deficits in<br />

adaptive behavior <strong>and</strong> originating during the developmental period (0-18 years of age).<br />

(44) Minor home modification--A physical adaptation to an individual's residence that is<br />

necessary to address the individual's specific needs <strong>and</strong> that enables the individual to function<br />

with greater independence in the individual's residence or to control his or her environment <strong>and</strong>:<br />

(A) is included on the list of minor home modifications in the CLASS Provider Manual; or<br />

(B) except as provided by §45.618(c) of this chapter (relating to Repair or Replacement of<br />

Minor Home Modification), is the repair <strong>and</strong> maintenance of a minor home modification<br />

purchased through the CLASS Program that is needed after one year has elapsed from the date<br />

the minor home modification is complete <strong>and</strong> that is not covered by a warranty.<br />

(45) Music therapy--The use of musical or rhythmic interventions to restore, maintain, or<br />

improve an individual's social or emotional functioning, mental processing, or physical health.<br />

(46) Natural supports--Assistance from persons, including family members <strong>and</strong> friends, that<br />

helps an individual live in a community <strong>and</strong> that occurs naturally within the individual's<br />

environment.<br />

(47) Nutritional services--The provision of nutrition services as defined in Texas Occupations<br />

Code, Chapter 701.<br />

(48) Occupational therapy--The practice of occupational therapy as described in Texas<br />

Occupations Code, Chapter 454.<br />

(49) Own home or family home--A residence that is not:<br />

(A) an ICF/MR licensed or subject to being licensed in accordance with Texas Health <strong>and</strong><br />

Safety Code, Chapter 252, or certified by DADS;<br />

(B) a nursing facility licensed or subject to being licensed in accordance with Texas Health<br />

<strong>and</strong> Safety Code, Chapter 242;<br />

(C) an assisted living facility licensed or subject to being licensed in accordance with<br />

Texas Health <strong>and</strong> Safety Code, Chapter 247;<br />

(D) a residential child-care operation licensed or subject to being licensed by DFPS unless<br />

it is a foster family home or a foster group home;<br />

(E) a facility licensed or subject to being licensed by the Department of State Health<br />

<strong>Services</strong>;<br />

(F) a facility operated by the Department of Assistive <strong>and</strong> Rehabilitative <strong>Services</strong>;<br />
