CLASS specialized therapies, the service limit is based on the 75th percentile of paid units for<br />

specialized therapy services, combined, for each individual who received the services during<br />

SFY 2010.<br />

The amendments <strong>and</strong> new sections further provide that DADS may grant an exception to the new<br />

limits with no exception to be greater than a service limit that is in effect now.<br />

The new limits will be effective December 1, 2011, <strong>and</strong> will expire on August 31, 2013.<br />

The amendments <strong>and</strong> new section also eliminate selected requisition <strong>and</strong> specification fees in the<br />

CBA <strong>and</strong> CLASS programs, effective December 1, 2011.<br />

The amendments also clarify HCSSA qualifications associated with providing CBA services<br />

under the personal assistance services category of licensure <strong>and</strong> change the initial training<br />

requirements for an attendant.<br />

ISSUES AND ALTERNATIVES<br />

DADS considered the following alternatives to implement the cost containment strategies but<br />

rejected them to minimize the potential impact on the health <strong>and</strong> welfare of individuals receiving<br />

HCS, CLASS, CBA <strong>and</strong> MDCP services:<br />

� using lower percentiles for the new service limits;<br />

� applying more stringent criteria for an individual to qualify for an exception to a new limit;<br />

<strong>and</strong><br />

� for CLASS, eliminating the requisition fee for specialized services.<br />

STAKEHOLDER INVOLVEMENT<br />

DADS scheduled a stakeholder meeting for Monday, August 22, 2011, to describe<br />

implementation plans, including letters to all individuals enrolled in the four waiver programs<br />

explaining the proposed changes. In addition, DADS has scheduled a public hearing that will be<br />

held on Tuesday, October 18, 2011, during the public comment period to accept written <strong>and</strong> oral<br />

testimony regarding the proposals.
