CLASS specialized therapies, the service limit is based on the 75th percentile of paid units for
specialized therapy services, combined, for each individual who received the services during
SFY 2010.
The amendments and new sections further provide that DADS may grant an exception to the new
limits with no exception to be greater than a service limit that is in effect now.
The new limits will be effective December 1, 2011, and will expire on August 31, 2013.
The amendments and new section also eliminate selected requisition and specification fees in the
CBA and CLASS programs, effective December 1, 2011.
The amendments also clarify HCSSA qualifications associated with providing CBA services
under the personal assistance services category of licensure and change the initial training
requirements for an attendant.
ISSUES AND ALTERNATIVES
DADS considered the following alternatives to implement the cost containment strategies but
rejected them to minimize the potential impact on the health and welfare of individuals receiving
HCS, CLASS, CBA and MDCP services:
� using lower percentiles for the new service limits;
� applying more stringent criteria for an individual to qualify for an exception to a new limit;
and
� for CLASS, eliminating the requisition fee for specialized services.
STAKEHOLDER INVOLVEMENT
DADS scheduled a stakeholder meeting for Monday, August 22, 2011, to describe
implementation plans, including letters to all individuals enrolled in the four waiver programs
explaining the proposed changes. In addition, DADS has scheduled a public hearing that will be
held on Tuesday, October 18, 2011, during the public comment period to accept written and oral
testimony regarding the proposals.
