the proposed enrollment IPC meets the eligibility criterion described in §45.201(a)(5) of this<br />

subchapter <strong>and</strong> the CLASS Program services specified in the IPC meet the requirements<br />

described in subsection (b) of this section, DADS notifies the individual's CMA, in writing, that<br />

the IPC is authorized.<br />

[begin addition] (g) The process by which an individual’s request for enrollment is denied of a<br />

CLASS Program service is denied, based on DADS review of a proposed enrollment IPC, is<br />

described in §45.216(d)-(f) of this division (relating to DADS Review of an Enrollment IPC).<br />

[begin deletion] (h) If DADS determines that the proposed enrollment IPC meets the<br />

eligibility criterion described in §45.201(a)(5) of this subchapter but that one or more of the<br />

CLASS Program services specified in the IPC do not meet the requirements described in<br />

subsection (b) of this section, DADS:]<br />

[(1) denies the service(s);]<br />

[(2) modifies the IPC; <strong>and</strong>]<br />

[(3) notifies the individual's CMA, in writing, of the action taken.]<br />

[(i) If DADS notifies the CMA that the individual's CLASS Program services have been<br />

denied <strong>and</strong> the proposed enrollment IPC modified in accordance with subsection (h) of this<br />

section, the CMA must:]<br />

[(1) implement the modified IPC; <strong>and</strong>]<br />

[(2) send written notice to the individual or LAR of the denial of CLASS Program<br />

<strong>Services</strong>, in accordance with §45.403(c) of this chapter (relating to Denial of a CLASS Program<br />

Service). [end deletion]<br />

[begin addition] (h) [end addition] [begin deletion] (j) [end deletion] The effective date of an<br />

enrollment IPC is one of the following, whichever is later:<br />

(1) the effective date as determined by the service planning team; or<br />

(2) the date DADS notifies the CMA that the individual's request for enrollment is<br />

approved <strong>and</strong> the IPC is authorized in accordance with [begin addition] §45.216(c) [end<br />

addition] [begin deletion] §45.216(d) [end deletion] or (e) of this division.<br />

[begin addition] (i) [end addition] [begin deletion] (k) [end deletion] An enrollment IPC is<br />

effective for an IPC period.<br />

[begin addition] (j) [end addition] [begin deletion] (l) [end deletion] An individual's<br />

enrollment IPC must be reviewed <strong>and</strong> updated in accordance with §45.223 of this subchapter<br />
