(e) A program provider must retain in an individual's record results <strong>and</strong> recommendations of<br />

individualized assessments that support the individual's current need for each service component<br />

included in the IPC.<br />

§9.166. Renewal <strong>and</strong> Revision of an IPC.<br />

(a) Renewal of the IPC. At least annually <strong>and</strong> before the expiration of an individual's IPC, the<br />

individual's IPC must be renewed in accordance with this subsection <strong>and</strong> with DADS'<br />

instructions.<br />

(1) At least 60 but no more than 90 calendar days before the expiration of an individual's<br />

IPC, a program provider must notify the service coordinator that the individual's IPC must be<br />

renewed.<br />

(2) Upon notification in accordance with paragraph (1) of this subsection, the service<br />

planning team must review the individual's PDP <strong>and</strong> update it, if necessary. If the PDP is<br />

updated, the service coordinator must send a copy of the updated PDP to the program provider<br />

within 10 calendar days after the PDP is updated.<br />

(3) At least 30 but no more than 60 calendar days before the expiration of the individual's<br />

IPC, the service planning team <strong>and</strong> the program provider must review the PDP <strong>and</strong> develop the<br />

proposed renewal IPC [begin addition] in accordance with §9.159(c) of this subchapter (relating<br />

to IPC) [end addition], including completion of the CDS portion of the proposed renewal IPC, if<br />

applicable, <strong>and</strong> the non-HCS Program services.<br />

(4) The program provider must, before the effective date of the proposed renewal IPC,<br />

develop an implementation plan for HCS Program services that is based on the individual's PDP<br />

<strong>and</strong> proposed renewal IPC.<br />

(5) Within seven calendar days after development of the proposed renewal IPC as required<br />

by paragraph (3) of this subsection, the program provider must comply with the requirements in<br />

subsection (e)(1) <strong>and</strong> (2) of this section.<br />

(6) Within seven calendar days after the program provider electronically transmits the<br />

proposed renewal IPC to DADS as required by subsection (e)(2) of this section, the service<br />

coordinator must comply with the requirements in subsection (e)(3) of this section.<br />

(7) The program provider must provide HCS Program services in accordance with an<br />

implementation plan that is based on the individual's PDP <strong>and</strong> authorized renewal IPC.<br />

(b) Revisions to the IPC. The service coordinator or the program provider may determine<br />

whether an individual's IPC needs to be revised to add a new HCS Program service or change the<br />

amount of an existing service.<br />
