[(2) completes, annually thereafter, the CLASS Individual Rights <strong>and</strong> Safeguards portion<br />

of such training [end deletion].<br />

(b) A DSA must ensure that, before providing services to an individual, a service provider of<br />

habilitation completes:<br />

(1) two hours of orientation covering the following:<br />

(A) an overview of related conditions; <strong>and</strong><br />

(B) an explanation of commonly performed tasks regarding habilitation;<br />

(2) training in cardiopulmonary resuscitation <strong>and</strong> choking prevention that includes an inperson<br />

evaluation by a qualified instructor of the service provider's ability to perform these<br />

actions; <strong>and</strong><br />

(3) training in the habilitation activities necessary to meet the needs <strong>and</strong> characteristics of<br />

the individual to whom the service provider is assigned, in accordance with the CLASS Provider<br />

Manual, with training to occur in the individual's home with full participation from the<br />

individual, if possible.<br />

(c) The supervisor of a service provider of habilitation must, in accordance with the CLASS<br />

Provider Manual, evaluate the performance of the service provider, in person, to ensure the<br />

needs of the individual are being met. The evaluation must occur annually.<br />

§45.806. Respite <strong>and</strong> Dental Treatment.<br />

(a) An individual may receive [begin addition] a maximum of [end addition] [begin deletion]<br />

no more than a total of [end deletion] [begin addition] 29 days [end addition] [begin deletion] 30<br />

calendar days [end deletion] of [begin addition] in-home <strong>and</strong> out-of-home [end addition] respite<br />

[begin addition] combined, during an [end addition] [begin deletion] per [end deletion] IPC<br />

period [begin addition], unless an exception is granted by DADS in accordance with §45.219(c)<br />

of this chapter (relating to Exception to Service Limits), in which case the individual may receive<br />

no more than 30 days of in-home <strong>and</strong> out-of-home respite, combined, during an IPC period in<br />

accordance with §45.219(d)(1)(C) of this chapter [end addition].<br />

(b) A DSA must ensure that:<br />

(1) in-home respite is provided in the individual's residence or the residence of a relative or<br />

friend that is not one of the settings listed in paragraph (2) of this subsection;<br />

(2) out-of-home respite is provided in one of the following:<br />

(A) an adult foster care home licensed by DADS in accordance with Chapter 48, Subchapter<br />
