(ii) the IPPs; [<strong>and</strong>]<br />

(iii) the habilitation plan; <strong>and</strong><br />

[begin addition] (iv) if the IPC includes a service described in §45.218(b) of this division in<br />

an amount that exceeds the service limit for that service, a completed Request for an Exception<br />

to Service Limit form as required by §45.219(b) of this division; <strong>and</strong> [end addition]<br />

(B) send a copy of the proposed enrollment IPC to the CDSA, if applicable.<br />

(d) If the individual or LAR requests a CLASS Program service that the case manager or DSA<br />

has determined does not meet the criteria described in subsection (b) of this section, [or] the<br />

requirements described in Subchapter F of this chapter (relating to Adaptive Aids <strong>and</strong> Minor<br />

Home Modifications) [begin addition], or, for transition assistance services, exceeds the service<br />

limit described in §45.218(c) of this division [end addition] the CMA must [begin addition]<br />

comply with this subsection. [end addition] [:]<br />

(1) [begin addition] The CMA must, [end addition] in accordance with CLASS Provider<br />

Manual, send the individual or LAR written notice of the denial of the requested CLASS<br />

Program service, copying the DSA <strong>and</strong> CDSA [begin addition], if the individual or LAR requests<br />

a CLASS Program service that the CMA or DSA has determined:<br />

(A) does not met the criteria described in subsection (b) of this section;<br />

(B) does not meet the requirements described in Subchapter F of this chapter (relating to<br />

Adaptive Aids <strong>and</strong> Minor Home Modifications); or<br />

(C) if the service is transition assistance services, exceeds the service limit described in<br />

§45.218(c) of this division.<br />

(2) If the CMA is required to send written notice of denial of a CLASS Program service as<br />

described in paragraph (1) of this subsection, the CMA must also: [end addition]<br />

[begin addition] (A) [end addition] [begin deletion] (2) [end deletion] no later than 30<br />

calendar days before the effective date of the proposed IPC as determined by the service<br />

planning team, submit to DADS for its review:<br />

enrollment IPC that includes the type <strong>and</strong> amount of CLASS Program services in dispute <strong>and</strong> not<br />

in dispute <strong>and</strong> is signed <strong>and</strong> dated by:<br />

or LAR;<br />

manager; <strong>and</strong><br />
