(3) ensure that the [begin addition] HCSSA [end addition] [begin deletion] HCSS registered
nurse (RN) [end deletion] provides the training specified in subparagraphs (A)-(C) of this
paragraph to the attendant in the participant's home, on or before the date of initiation of service:
(A) [begin addition] tasks to be performed [end addition] [begin deletion] information
about the participant's health condition and how it may affect the performance of tasks [end
deletion];
(B) [begin deletion] tasks to be performed,] work schedule[begin deletion], and safety
and emergency procedures [end deletion]; and
(C) [begin addition] emergency procedures [end addition] [begin deletion] symptoms or
changes in the participant's health status about which the unlicensed person should notify either
the RN or the attending physician [end deletion].
§48.6098. Circumstances Requiring [begin addition] Termination [end addition] [begin
deletion] Denial [end deletion] of [begin addition] CBA Services with Advance Notice.
(a) If one or more of the circumstances specified in paragraphs (1) through (10) of this
subsection occur, the [begin addition] CBA [end addition] [begin deletion] Community Based
Alternatives (CBA) [end deletion] provider [begin deletion] agency [end deletion] must provide
written documentation to the [begin addition] DADS [end addition] [begin deletion] Texas
Department of Human Services (DHS) [end deletion] case manager within two [begin addition]
DADS [end addition] [begin addition] DHS [end deletion] workdays [begin addition] after [end
addition] [of] the occurrence to support a recommendation for [begin addition] termination [end
addition] [begin deletion] denial [end deletion] of CBA services. [begin deletion] Advance notice
is defined in §48.6002 of this title (relating to Community Based Alternatives (CBA)
Definitions). [end deletion]
(1) The [begin addition] individual [end addition] [begin deletion] participant [end
deletion] leaves the state for more than 90 days. [begin addition] DADS retains [end addition]
[begin deletion] DHS will retain [end deletion] authority to extend this time in extraordinary
circumstances.
(2) The [begin addition] individual [end addition] [begin deletion] participant [end
deletion] has been legally confined or has resided in an institutional setting for longer than 120
days. An institution includes legal confinement, an acute care hospital, state hospital,
rehabilitation hospital, state school, nursing home, or intermediate care facility for persons with
mental retardation/related conditions (ICF-MR/RC). [begin addition] DADS retains [end
addition] [begin deletion] DHS will retain [end deletion] authority to extend this time in
extraordinary circumstances.
(3) The [begin addition] individual [end addition] [begin deletion] participant [end
deletion] is not financially eligible for Medicaid benefits.
