(b) Respite [begin addition] <strong>and</strong> adjunct support services [end deletion].<br />

(1) Respite services may not be provided in a setting in which identical services are already<br />

being provided.<br />

(2) [begin addition] Subject to an exception granted by DADS in accordance with §51.232<br />

of this division (relating to Exception to Service Limit), an individual may receive a maximum of<br />

2,096 hours of respite during an IPC year, of which 144 hours (six days) may be used for facility<br />

based respite. [begin deletion] Facility-based respite is limited to 29 days per IPC year. If an<br />

individual or the individual's parent or guardian requests an extension of the 29-day limit, the<br />

case manager must inform DADS' Access <strong>and</strong> Intake Division of the number of days requested<br />

beyond the 29-day limit <strong>and</strong> the reason for the request. DADS' Access <strong>and</strong> Intake Division<br />

approves or denies the request. [end deletion]<br />

[begin addition] (3) The service limit described in paragraph (2) of this subsection is in effect<br />

through August 31, 2013.<br />

(4) Effective September 1, 2013, an individual may be admitted to facility-based respite for<br />

a maximum of 29 days during an IPC year with the amount of respite other than facility-based<br />

respite subject to the IPC cost limit as described in §51.203(7) of this subchapter (relating to<br />

Eligibility Requirements). If the DADS case manager receives information demonstrating the<br />

need of the parent or guardian to admit the individual to facility-based respite in excess of 29<br />

days during an IPC year, the DADS case manager determines whether providing facility-based<br />

respite in excess of the limit is necessary for the IPC to meet the criteria described in §51.217(b)<br />

of this subchapter (relating to Individual Plan of Care).<br />

(c) Adjunct support services.<br />

(1) Subject to an exception granted by DADS in accordance with §51.232 of this division<br />

(relating to Exception to Service Limit), an individual may receive a maximum of 1,875 hours of<br />

adjunct support services during an IPC year.<br />

(2) The service limit described in paragraph (1) of this subsection is in effect through<br />

August 31, 2013. [end addition]<br />

(3) Adjunct support services may be used only when the primary caregiver is working,<br />

attending job training, or attending school.<br />

(1) [begin addition] An individual may receive adaptive aids having a maximum cost of<br />
