§161.021, which provides that the <strong>Aging</strong> <strong>and</strong> <strong>Disability</strong> <strong>Services</strong> <strong>Council</strong> shall study <strong>and</strong> make<br />

recommendations to the HHSC executive commissioner <strong>and</strong> the DADS commissioner regarding<br />

rules governing the delivery of services to persons who are served or regulated by DADS; <strong>and</strong><br />

Texas Government Code, §531.021, which provides HHSC with the authority to administer<br />

federal funds <strong>and</strong> plan <strong>and</strong> direct the Medicaid program in each agency that operates a portion of<br />

the Medicaid program.<br />

The amendments affect Texas Government Code, §531.0055 <strong>and</strong> §531.021, <strong>and</strong> Texas Human<br />

Resources Code, §161.021.<br />

§45.223. Renewal <strong>and</strong> Revision of an IPC.<br />

(a) Beginning the effective date of an individual's IPC, as determined by [begin addition]<br />

§45.214(h) [end addition] [begin deletion] §45.214(j) [end deletion] of this subchapter (relating<br />

to Development of Enrollment IPC) or §45.222(b) of this division (relating to Renewal IPC <strong>and</strong><br />

Requirement for Authorization to Continue <strong>Services</strong>), a case manager must, at least every 90<br />

calendar days, meet with the individual or LAR in the individual's home to review the<br />

individual's progress toward achieving the goals <strong>and</strong> objectives as described on the IPP for each<br />

CLASS Program service listed on the individual's IPC. The case manager must document the<br />

results of the review in the individual's record.<br />

(b) An individual's case manager must:<br />

(1) convene a service planning team that develops a proposed renewal IPC, new IPPs <strong>and</strong> a<br />

new habilitation plan at least annually, but no more than 90 calendar days before the end of the<br />

IPC period of the IPC being renewed; <strong>and</strong><br />

(2) if the case manager becomes aware that the individual's need for a CLASS Program<br />

service changes, develop, within five business days after becoming aware, a proposed revised<br />

IPC <strong>and</strong> revised IPP(s) <strong>and</strong>, if necessary, a revised habilitation plan.<br />

(c) The case manager must ensure that:<br />

(1) a proposed renewal IPC <strong>and</strong> proposed revised IPC, developed in accordance with<br />

subsection (b)(1) or (2) of this section, meet the criteria described in §45.214(a)(1)(B) <strong>and</strong> (b) of<br />

this subchapter; <strong>and</strong><br />

(2) new or revised IPPs developed in accordance with subsection (b)(1) or (2) of this<br />

section are reviewed, signed, <strong>and</strong> dated as evidence of agreement by:<br />

(A) the individual or LAR;<br />

(B) the case manager; <strong>and</strong><br />

(C) the DSA.<br />
