(d) If the individual or LAR, case manager, <strong>and</strong> DSA agree on the type <strong>and</strong> amount of<br />

services to be included in a proposed renewal IPC or a proposed revised IPC developed in<br />

accordance with subsection (b) of this section, the case manager must:<br />

(1) ensure that the proposed renewal IPC or proposed revised IPC is reviewed, signed, <strong>and</strong><br />

dated as evidence of agreement by:<br />

(A) the individual or LAR;<br />

(B) the case manager; <strong>and</strong><br />

(C) the DSA; <strong>and</strong><br />

(2) submit [begin addition] to DADS for its review [end addition] the proposed IPC, IPPs,<br />

[begin deletion] <strong>and</strong> [end deletion] habilitation plan [begin addition], <strong>and</strong> if the individual or<br />

LAR requests a service described in §45.218(b) of this division (relating to Service Limits) in an<br />

amount that exceeds the service limit for that service, a completed Request for an Exception to<br />

Service Limit form as required by §45.219(b) of this division (relating to Exception to Service<br />

Limits) [end addition] [begin deletion] to DADS for its review [end deletion] in accordance with<br />

the following:<br />

(A) for a proposed renewal IPC developed in accordance with subsection (b)(1) of this<br />

section, the proposed renewal IPC, new IPPs, [begin deletion] <strong>and</strong> [end deletion] new<br />

habilitation plan [begin addition], <strong>and</strong> any completed Request for an Exception to Service Limit<br />

Form [end addition] must be submitted to DADS at least 30 calendar days before the end of the<br />

IPC period; <strong>and</strong><br />

(B) for a proposed revised IPC developed in accordance with subsection (b)(2) of this section,<br />

the proposed revised IPC, any revised IPPs, [begin deletion] <strong>and</strong> [end deletion] any revised<br />

habilitation plan [begin addition], <strong>and</strong> any completed Request for an Exception to Service Limit<br />

form [end addition] must be submitted to DADS at least 30 calendar days before the effective<br />

date proposed by the service planning team; <strong>and</strong><br />

(3) send a copy of the proposed renewal or proposed revised IPC to the CDSA, if<br />

applicable.<br />

(e) If the individual or LAR requests a CLASS Program service that the case manager or DSA<br />

has determined does not meet the criteria described in §45.214(b) of this subchapter or the<br />

requirements described in Subchapter F (relating to Adaptive Aids <strong>and</strong> Minor Home<br />

Modifications) [begin addition], that exceeds a service limit described in §45.218 of this division<br />

the [begin addition] CMA [end addition] [begin deletion] case manager [end deletion] must<br />

[begin addition] comply with this subsection. [end addition] [:]<br />

(1) [begin addition] The CMA must, [end addition] in accordance with the CLASS<br />

Provider Manual, send the individual or LAR written notice of the denial or proposal to reduce,<br />

as appropriate, the requested CLASS Program service, copying the DSA <strong>and</strong> CDSA, if the<br />
