I 'return herewith, without my approval, order passed by your Honorable<br />

Board, granting full pay to all city employees who are Incapacitated.<br />

Our city employees at the present time receive all the benefits that<br />

the laws provide for injuries sustained in performance <strong>of</strong> their duties. This<br />

<strong>City</strong> has accepted the provisions <strong>of</strong> the Workmen's Compensation Act and all<br />

employees who are Injured receive a minimum <strong>of</strong> twenty dollars ($20.00) per<br />

week, plus all medical and hospital expenses, during the period <strong>of</strong> their Incapacity<br />

and if the injury is a permanent injury they are entitled to a pension<br />

from the date <strong>of</strong> their injury.<br />

After consultation with the <strong>City</strong> Solicitor, I am <strong>of</strong> the opinion<br />

that we have no authority to give full pay to any employee under these circumstances.<br />

The authorization for both Workmen's Compensation and Pension<br />

rights are created by Acts <strong>of</strong> the Legislature. There is no authorization for<br />

granting <strong>of</strong> full pay for injuries received In performance <strong>of</strong> duty.<br />
