chAPTeR 9: The RighT To<br />

hAbiliTATi<strong>on</strong> And RehAbiliTATi<strong>on</strong><br />

Un c<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights of Pers<strong>on</strong>s with disabilities<br />

Article 26, habilitati<strong>on</strong> and rehabilitati<strong>on</strong>:<br />

1. States Parties shall take effective and appropriate measures, including through<br />

peer support, to enable pers<strong>on</strong>s with disabilities to attain and maintain maximum<br />

independence, full physical, mental, social and vocati<strong>on</strong>al ability, and full inclusi<strong>on</strong> and<br />

participati<strong>on</strong> in all aspects of life. To that end, States Parties shall organize, strengthen<br />

and extend comprehensive habilitati<strong>on</strong> and rehabilitati<strong>on</strong> services and programmes,<br />

particularly in the areas of health, employment, educati<strong>on</strong> and social services, in such a<br />

way that these services and programmes:<br />

a. Begin at the earliest possible stage, and are based <strong>on</strong> the multidisciplinary<br />

assessment of individual needs and strengths;<br />

b. Support participati<strong>on</strong> and inclusi<strong>on</strong> in the community and all aspects of society, are<br />

voluntary, and are available to pers<strong>on</strong>s with disabilities as close as possible to their<br />

own communities, including in rural areas.<br />

2. States Parties shall promote the development of initial and c<strong>on</strong>tinuing training for<br />

professi<strong>on</strong>als and staff working in habilitati<strong>on</strong> and rehabilitati<strong>on</strong> services.<br />

3. States Parties shall promote the availability, knowledge and use of assistive devices<br />

and technologies, designed for pers<strong>on</strong>s with disabilities, as they relate to habilitati<strong>on</strong><br />

and rehabilitati<strong>on</strong>.<br />

obJecTives<br />

The background informati<strong>on</strong> and exercises c<strong>on</strong>tained in this chapter will enable participants to<br />

work towards the following objectives:<br />

• Define the right to habilitati<strong>on</strong> and rehabilitati<strong>on</strong><br />

• Explain the importance of the right to habilitati<strong>on</strong> and rehabilitati<strong>on</strong> for people with<br />

disabilities<br />

• Understand the interrelati<strong>on</strong>ship between the right to habilitati<strong>on</strong> and rehabilitati<strong>on</strong> and<br />

other human rights<br />

• Understand the process of developing habilitati<strong>on</strong> and rehabilitati<strong>on</strong> plans<br />

• Identify ways in which the right to habilitati<strong>on</strong>/rehabilitati<strong>on</strong> has been promoted or denied<br />

• Understand the provisi<strong>on</strong>s <strong>on</strong> habilitati<strong>on</strong> and rehabilitati<strong>on</strong> in the UN c<strong>on</strong>venti<strong>on</strong> <strong>on</strong><br />

the Rights of Pers<strong>on</strong>s with disabilities (CRPD).<br />
